Abstract

PELAKSANAAN PENDAFTARAN TANAH SISTEMATIS LENGKAP UNTUK KEPASTIAN HUKUM HAK ATAS TANAH ADAT DI KABUPATEN KAMPAR AANDRI WARDI NIM 1820123028 ABSTRAK Tanah adat dalam istilah hukum pertanahan dikenal dengan pendaftaran tanah secara sistematis dan pendaftaran tanah secara sporadis. Kedua kegiatan ini tidak perlu didahului dengan proses jual beli. Pokok permasalahan dalam penelitian ini adalah bagaimanakah proses pengadaan alas hak terhadap hak atas tanah adat dalam Pendaftaran Tanah Sistematis Lengkap di Kabupaten Kampar, bagaimanakah pelaksanaan Pendaftaran Tanah Sistematis Lengkap untuk kepastian hukum hak atas tanah adat di Kabupaten Kampar dan bagaimanakah penyelesaian sengketa terhadap hak atas tanah adat dalam Pendaftaran Tanah Sistematis Lengkap di Kabupaten Kampar. Penelitian hukum ini menggunakan pendekatan yuridis empiris yaitu suatu penelitian yang menggunakan metode pendekatan terhadap masalah dengan melihat norma-norma hukum yang berlaku kemudian dihubungkan dengan fakta-fakta hukum yang terdapat dilapangan. Dalam penelitian ini sumber data diperoleh dari penelitian kepustakaandan penelitian lapangan. Teknik pengumpulan data dilakukan melalui wawancara terstruktur dan studi dokumen. Hasil Penelitian Proses pengadaan alas hak terhadap hak atas tanah adat dalam PTSL di Kabupaten Kampar banyak terjadi permasalahan hal ini dikarenakan alas hak menjadi penting karena dasar bukti kepemilikan atas tanah selain sertipikat adalah alas hak. Alas hak pula yang dijadikan dasar untuk pendaftaran tanah. Dengan adanya Hukum Pertanahan Nasional diharapkan terciptanya kepastian hukum di Indonesia. Pelaksanaan PTSL untuk kepastian hukum hak atas tanah adat di Kabupaten Kampar tidak sesuai dengan Peraturan Menteri ATR/Kepala BPN Nomor 6 Tahun 2018 tentang Pendaftaran Tanah Sistematis Lengkap dikarenakan masih banyak kendala dan masalah yang terjadi dilapangan. Yang mana sesuai Peraturan Menteri ATR/Kepala BPN Nomor 6 Tahun 2018 tentang Pendaftaran Tanah Sistematis Lengkap Pasal 2 ayat 2. Penyelesaian sengketa terhadap hak atas tanah adat dalam PTSL di Kabupaten Kampar yaitu melalui jalur mediasi. Kementerian Agraria dan Tata Ruang tidak berwenang menangani kasus pertanahan. Namun, Kementerian Agraria dan Tata Ruang dapat mengambil inisiatif untuk memfasilitasi penyelesaian sengketa atau konflik melalui jalur mediasi. Jalur mediasi dalam aturan ini ditempuh juga untuk jenis sengketa atau konflik, baik yang menjadi kewenangan kementerian atau yang bukan menjadi kewenangan kementerian. Kata Kunci : Pelaksanaan, PTSL, Kepastian Hukum, Hak Atas Tanah Adat IMPLEMENTATION OF COMPLETE SYSTEMATIC LAND REGISTRATION FOR LEGAL SATISFACTION OF INDIGENOUS LAND IN KAMPAR DISTRICT AANDRI WARDI NIM 1820123028 ABSTRACT Customary land in the term of land law is known as systematic land registration and sporadic land registration.Both of these activities do not need to be preceded by the buying and selling process. The main problem in this research is how the process of procuring the basis of rights to customary land rights in Complete Systematic Land Registration in Kampar District, how is the implementation of Systematic Complete Land Registration for legal certainty of customary land rights in Kampar Regency and how is the resolution of disputes over customary land rights in Complete Systematic Land Registration in Kampar District. This legal research uses an empirical juridical approach which is a study that uses a method of approach to the problem by looking at the applicable legal norms and then related to the legal facts contained in the field. In this study the source of data obtained from library research and field research. Data collection techniques are done through structured interviews and document studies.Research Results The process of procuring the basis of rights to customary land rights in PTSL in Kampar District has many problems, because the basis for rights is important because the basis for proof of ownership of land besides certificates is the basis of rights. Also, rights are the basis for land registration. With the existence of the National Land Law, legal certainty is expected to be created in Indonesia. PTSL implementation for legal certainty of customary land rights in Kampar Regency is not in accordance with Minister of ATR Regulation / Head of BPN Number 6 of 2018 concerning Complete Systematic Land Registration because there are still many obstacles and problems that occur in the field. Which according to the ATR Minister Regulation / Head of BPN Number 6 of 2018 concerning Complete Systematic Land Registration Article 2 paragraph 2. Settlement of disputes over customary land rights in PTSL in Kampar Regency through mediation channels. The Ministry of Agrarian Affairs and Spatial Planning is not authorized to handle land cases. However, the Ministry of Agrarian Affairs and Spatial Planning can take the initiative to facilitate the resolution of disputes or conflicts through mediation channels. The mediation path in this regulation is also taken for types of disputes or conflicts, both those which are the authority of the ministry or those which are not the authority of the ministry.
