Abstract

ABSTRAK Maraknya tindak pidana illegal logging di Kabupaten Pesisir Selatan, sehingga mengancam kelestarian ekosistem hutan produksi. Fenomena kayu temuan tanpa tersangka dan penindakan di tingkat hilir menunjukkan bahwa penegakan hukum belum menyentuh aktor intelektual (manus domina). Permasalahan dalam penelitian ini adalah: 1) Bagaimana implementasi tugas dan fungsi UPTD KPHP Pesisir Selatan dalam penanggulangan tindak pidana illegal logging berdasarkan Peraturan Gubernur Sumatera Barat Nomor 28 Tahun 20242; 2) Bagaimana hambatan yang dihadapi?; 3) Bagaimana upaya mengatasi hambatan tersebut? Metode penelitian yang digunakan adalah yuridis empiris dengan sifat penelitian deskriptif analitis. Hasil penelitian menunjukkan bahwa implementasi tugas dan fungsi UPTD KPHP, masih belum maksimal karena, secara normatif fungsi yang diberikan di dominasi oleh fungsi memfasilitasi. Hal ini menciptakan keterbatasan kewenangan bagi UPTD KPHP, sehingga membuat para pelaku illegal logging sulit tersentuh sanksi pidana. Mengenai hambatan utama terdiri dari faktor internal berupa defisit anggaran operasional, keterbatasan sarana dan prasarana dan kurangnya kuantitas dan kualitas SDM, serta faktor eksternal berupa kondisi geografis yang ekstem dan rendahnya partisipasi masyarakat akibat ketergantungan ekonomi pada hasil hutan. Upaya yang dilakukan meliputi upaya preemtif melalui edukasi penyuluhan dan sosialisasi, pemasangan papan informasi perlindungan hutan, kemudian upaya preventif melalui patroli pengaman hutan dan pembentukan LMPHBN, serta upaya represif melalui koordinasi lintas sektoral dengan Kepolisian, PPNS dan pengadilan Negeri. ABSTRACT The increasing prevalence of illegal logging crimes in Pesisir Selatan Regency poses a serious threat to the sustainability of production forest ecosystems. The phenomenon of confiscated timber without identified suspects and law enforcement actions focused only at the downstream level indicates that law enforcement has not yet reached the intellectual actors (manus domina) behind such crimes. The problems examined in this study are: (1) How is the implementation of the duties and functions of the UPTD KPHP Pesisir Selatan in tackling illegal logging crimes based on West Sumatra Governor Regulation Number 28 of 2024?; (2) What obstacles are encountered?; and (3) What efforts have been undertaken to overcome such obstacles? The research method employed is empirical juridical research with a descriptive-analytical approach. The findings indicate that the implementation of the duties and functions of the UPTD KPHP has not been optimal because, normatively, the functions assigned are predominantly facilitative in nature. This condition creates limitations in the authority of the UPTD KPHP, thereby making perpetrators of illegal logging difficult to subject to criminal sanctions. The main obstacles consist of internal factors, including operational budget deficits, limited facilities and infrastructure, and inadequate quantity and quality of human resources, as well as external factors, including extreme geographical conditions and low community participation due to economic dependence on forest products. The efforts undertaken include pre-emptive measures through educational counseling and socialization, the installation of forest protection information boards, preventive measures through forest security patrols and the establishment of the Forest Protection and Conservation Community Institution (LMPHBN), as well as repressive measures through cross-sectoral coordination with the Police, Civil Servant Investigators (PPNS), and the District Court.
