Abstract

Overwhelm is a deed violance done by more than one person to a victim that can hurt or oven die. Indonesia as a legal state can be defined the state never to give rights to people to overwhelm moreover up to died. Ovewhelm often to do tens of people and that can be police trouble for arrest overwhelm accused. This research is focus on the Implementation of police investigation and the considering of officer in settled the person in case of overwhelm, and the problem faced by the officer. This research often on police rescHt Solok. Type of this research is sociological, approach used is juridical empirical and descriptive nature of the research. Research Data obtained by means of a research library to get secondary data and field research carried out with the study of documents and interviews to obtain primary data. Sampling to interviewed in this study was conducted by the method of purposive sampling that investigators Polres Solok. The Data collected from research results analyzed by qualitative methods so that it brings about the process of conclusion of empirical investigation juridical towards peipetrators of the crime overwhelm. The result of analysis shows that the process of police investigation is same as the commonly criminal acts, the officer is just more precise in processing the substanced of article 170 Criminal Code clauses toward person's crime. The sheaf ofjudical investigation is made into displit. In determine the person's crime is based on the article 170 Criminal Code clause is about the person who did the violance towards a victim including witness and evidence. The problem faced by the officer is long anough distance and nothing people to want evidence. Writer sugest for people that to report the overwhelm to police and police to add the officer on resort area.
