Abstract

Jual beli tanah adalah perbuatan hukum yang berupa penyerahan hak milik (penyerahan tanah untuk selama-lamanya) oleh penjual kepada pembeli, yang pada saat itu juga membayar harganya kepada penjual. Jual beli tanah dilakukan menggunakan Akta Jual Beli yang dibuat di hadapan Pejabat Pembuat Akta Tanah, tetapi dalam praktiknya seringkali masyarakat melakukan jual beli hak atas tanah menggunakan Perjanjian Pengikatan Jual Beli terlebih dahulu, hal ini disebabkan karena pembuatan Akta Jual Beli belum bisa dilakukan. Salah satu Perjanjian Pengikatan Jual Beli yang dibatalkan oleh Putusan Pengadilan adalah Putusan Pengadilan Negeri Padang Nomor: 12/PDT.G/2024/PN PDG. Adapun rumusan masalah yang penulis teliti, yaitu: 1). bagaimana pertimbangan Majelis Hakim dalam Putusan Pengadilan Negeri Padang Nomor 12/Pdt.G/2024/PN Pdg; dan 2). bagaimana akibat hukum terhadap penjual dan pembeli atas perjanjian pengikatan jual beli yang dibatalkan oleh putusan pengadilan. Tesis ini dikaji dengan teori perlindungan hukum dan teori kepastian hukum. Metode yang digunakan dalam penelitian ini adalah yuridis normatif dengan pendekatan kasus, yang datanya diperoleh dari data sekunder dalam bentuk studi dokumen yang dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa pertimbangan hukum Majelis Hakim yang membatalkan Perjanjian Pengikatan Jual Beli dalam putusan a quo, yaitu adanya wanprestasi yang dilakukan oleh Pihak Pembeli. Atas wanprestasi yang dilakukan oleh Pihak Pembeli, Pihak Penjual telah memberikan surat peringatan (somasi) sebanyak dua kali dan telah memberikan tambahan waktu pembayaran kepada Pihak Pembeli tetapi Pihak Pembeli tetap tidak melakukan kewajibannya. Akibat hukum pembatalan Perjanjian Pengikatan Jual Beli oleh putusan a quo adalah pengembalian pada posisi semula yakni hak atas tanah kembali kepada si penjual sebagaimana halnya sebelum terjadi perjanjian. Perjanjian pengikatan jual beli yang telah dibatalkan, tidak lagi mengikat para pihak. Selain itu, akibat pembatalan perjanjian yaitu pembayaran yang dilakukan oleh Pihak Pembeli sejumlah Rp.500.000.000, tidak dikembalikan kepada Pihak Pembeli. Pembayaran tahap pertama sampai tahap ketiga yang dilakukan oleh Pihak Pembeli tetap menjadi milik Pihak Penjual. Selain itu, Pihak Pembeli juga dikenakan penggantian biaya sejumlah Rp.26.000.000. Land sale and purchase is a legal act in the form of transfer of ownership rights (transfer of land forever) by the seller to the buyer, who at that time also pays the price to the seller. Land sale and purchase is carried out using a Sale and Purchase Deed made before the Land Deed Making Officer, but in practice people often carry out the sale and purchase of land rights using a Sale and Purchase Binding Agreement first, this is because the making of the Sale and Purchase Deed cannot be done yet. One of the Sale and Purchase Binding Agreements that was canceled by the Court Decision is the Padang District Court Decision Number: 12/PDT.G/2024/PN PDG. The formulation of the problem that the author is researching, namely: 1). how is the consideration of the Panel of Judges in the Padang District Court Decision Number 12/Pdt.G/2024/PN Pdg; and 2). what are the legal consequences for the seller and buyer of the sale and purchase binding agreement that was canceled by the court decision. This thesis is studied with the theory of legal protection and the theory of legal certainty. The method used in this research is normative juridical with a case approach, the data for which is obtained from secondary data in the form of document studies which are analyzed qualitatively. The research results indicate that the Panel of Judges' legal consideration for annulling the Binding Sale and Purchase Agreement in the a quo decision was the Buyer's default. Due to the Buyer's default, the Seller had issued two warning letters (sumasi) and granted additional payment deadlines to the Buyer, but the Buyer still failed to fulfill its obligations. The legal consequence of the cancellation of the Binding Sale and Purchase Agreement by the a quo decision is the return of the land rights to the seller, as they were before the agreement. The cancelled Binding Sale and Purchase Agreement is no longer binding on the parties. Furthermore, the cancellation of the agreement resulted in the Buyer's payment of Rp. 500,000,000 not being returned to the Buyer. The first through third payments made by the Buyer remain the property of the Seller. Furthermore, the Buyer was also required to reimburse Rp. 26,000,000.
