Abstract

Human rights are the fundamental rights owned by every human since they was born and was a grace of God that must be respected, upheld and protected by the state, law, government and every person. 20'^ century is the culmination of the progress and awareness of human rights, it is seen from the establishment of a united nations and make international legal instruments on human rights, but doesn't make guarantee that against human rights violations decreased or no longer available. When Aung San Suu Kyi struggle for democracy in Myanmar, the government ofMyanmar making arrests in an arbitrary manner against her because she was considered a person who has committed or is committing or is believed to perform acts that endanger state security and sovereignty of Myanmar. Therefore,writer are interested to discussing the issue with the problems: 1) Whether the arrest of Aung San Suu Kyi by the state of Myanmar against the international law on Human Rights, 2) How is the state's responsibility ofMyanmar for detention Aung San Suu Kyi. Research method used by writer is a method ofjuridicial normative, so that the data used is Just futile secondary data which includes the primary law, secondary, and tertiary where the analysis is done by the qualitative descriptive that data and the fact the law has been thoroughly described and the conclusions drawn. Asfor the conclusion of this thesis are: in the event of detention ofAung San Suu Kyi, the state of Myanmar guilty of a violation of individual rights set out in the Universal Declaration of Human Rights, International Covenant on Civil and Political Rights and International Covenant on Economic, Social and Cultural Rights. Myanmar have a state responsibility to release Aung San Suu Kyifrom detention and conduct judicial remedy against Aung San Suu Kyi for having violated the rights of the individual.
