Abstract

PEMBERHENTIAN DAN PERGANTIAN ANTAR WAKTU PIMPINAN PADA DEWAN PERWAKILAN RAKYAT DAERAH (DPRD) KABUPATEN KEPULAUAN MENTAWAI Yolga Mariza Ali Azri, 1620112005, Magister Ilmu Hukum Universitas Andalas, 146 Halaman, Tahun 2018 ABSTRAK Masa jabatan Pimpinan DPRD terhitung sejak tanggal pengucapan sumpah/janji Pimpinan dan berakhir bersamaan dengan berakhirnya masa jabatan keanggotaan DPRD. Pimpinan DPRD berhenti dari jabatannya sebelum berakhir masa jabatan karena meninggal dunia, mengundurkan diri sebagai Pimpinan DPRD, berhenti sebagai anggota DPRD sesuai dengan peraturan perundang-undangan, atau diberhentikan sebagai Pimpinan DPRD. Pemberhentian Pimpinan DPRD ditetapkan oleh Gubernur. Di Kabupaten Kepulauan Mentawai pemberhentian Pimpinan DPRD tidak ditetapkan oleh Gubernur Sumatera Barat. Penelitian Ini membahasa tentang 1) Bagaimanakah mekanisme pemberhentian Pimpinan DPRD di Kabupaten Kepulauan Mentawai 2) Bagaimanakah mekanisme pengusulan pengajuan calon pengganti pimpinan DPRD di Kabupaten Kepulauan Mentawai 3) Bagaimanakah Pelaksanaan Penggantian antarwaktu pimpinan DPRD diKabupaten Kepulauan Mentawai. Metode penelitian yang digunakan adalah metode Yuridis Sosiologis. Jenis penelitian ini bersifat Deskriptif. Data yang digunakan dalam penelitian ini adalah data Primer dan data sekunder. Pengumpulan data yang digunakan dalam penelitin ini adalah wawancara dan studi dokumen. Pengolahan bahan dianalisis secara kualitatif. Berdasarkan hasil penelitian dapat disimpulkan bahwa 1) Mekanisme pemberhentian Pimpinan DPRD diusulkan oleh Partai Politik kepada Pimpinan DPRD. Pimpinan DPRD melaporkan usul pemberhentian pimpinan DPRD dalam rapat Paripurna DPRD. Pemberhentian Pimpinan DPRD ditetapkan dalam Keputusan DPRD. Keputusan DPRD tentang pemberhentian Pimpinan DPRD disampaikan oleh Pimpinan DPRD kepada Gubernur melalui Bupati Untuk peresmian pemberhentian sebagai Pimpinan DPRD akan tetapi di Kabupaten Kepulauan Mentawai mekanisme pemberhentian Pimpinan DPRD ini tidak dilaksanakan dikarenakan pemberhentian Pimpinan tidak diusulkan oleh Partai politik. 2) Mekanisme Pengusulan calon pengganti Pimpinan DPRD diusulkan oleh partai Politik kepada Pimpinan DPRD kemudian pimpinan DPRD mengumumkan usulan calon pengganti Pimpinan DPRD di dalam rapat Paripurna DPRD, usulan tersebut ditetapkan didalam Keputusan DPRD. 3) Pelaksanaan pengganti antar waktu diresmikan oleh Gubernur dengan Surat keputusan Gubernur tentang peresmian pengangkatan calon pengganti Pimpinan DPRD. Masa jabatan Pimpinan DPRD pengganti antar waktu terhitung sejak tanggal pengucapan sumpah/janji Pimpinan. Pengucapan Sumpah/janji Pimpinan di pandu oleh ketua Pengadilan Negeri, atau Wakil ketua Pengadilan Negeri ataupun oleh hakim Senior yang di tunjuk oleh Ketua Pengadilan Negeri sedangkan Pemandu Pengucapan sumpah/janji untuk pimpinan DPRD pengganti antarwaktu tidak di atur didalam Tata Tertib DPRD Kabupaten Kepulauan Mentawai sehingga Pemandu pengucapan Sumpah/janji pimpinan DPRD Pengganti antar waktu dipandu oleh Pimpinan DPRD lainnya. Kata Kunci : Pimpinan DPRD, Pemberhentian Pimpinan DPRD, Penggantian Antarwaktu pimpinan DPRD TERMINATION AND REPLACEMENT OF INTER-TIME FOR THE LEADERS IN REGIONAL HOUSE OF REPRESENTATIVES (RHoR) IN REGENCY OF MENTAWAI ISLANDS Yolga Mariza Ali Azri, 1620112005, Master of Law in Andalas University, 146 Pages, Year 2018 ABSTRACT Term of office for the parliament leaders starts from the date of the oath/appointment and ends in the same time of the end of affiliation term for the parliament. The parliament leaders can be dismissed from their positions before ending their term of office due to death, resigning as RHoR leaders, quitting as RHoR members in accordance with the legislation, or terminated as RHoR Leaders. Dismissal of the parliament leaders is determined by the Governor, in the Mentawai Islands Regency the dismissal of the parliament leaders was not determined by the Governor of West Sumatra. This research examines about 1) How is the termination mechanism of the RHoR Leaders in Mentawai Islands regency 2) How to propose proposal mechanism for replacement of RHoR leaders in Mentawai Islands regency 3) How to implement Replacement of inter-time of RHoR leadership in Mentawai Islands Regency. This research uses the Sociological Juridical method. Type of research is a descriptive. This research uses primary data and secondary data. The data are collected by using interview and study of document. The data are analyzed qualitatively. Based on the results of the research, it can be concluded that 1) The mechanism for dismissal of RHoR Leaders is proposed by Political Parties to the RHoR Leaders. RHoR leaders report a proposal for dismissal of RHoR leaders in parliament plenary meetings. Dismissal of the RHoR leaders is stipulated in the parliament’s decision regarding the dismissal of the RHoR Leaders which was conveyed by the RHoR Leaders to the Governor through the Regent. For the official announcement of the dismissal as the RHoR leaders, however, in the Mentawai Islands Regency the mechanism for dismissal of the RHoR Leaders is not carried out because the dismissal of the leader is not proposed by the political party. 2) The mechanism for proposing substitute candidates for the RHoR leadership is proposed by political parties to the RHoR leadership then the RHoR leadership announces the proposal of candidates for the RHoR leadership in the RHoR plenary session, the proposal stipulated in the RHoR decree. 3) The implementation for replacement of inter-time is formalized by the Governor with a Governor's Decree concerning the official announcement of the appointment of candidates to replace the RHoR leaders. The term of office of the replacement RHoR Leader is between the date from the date of the leadership's oath / promise. The oath/promise of the leader is guided by the head of the District Court, or the Deputy Chairperson of the District Court or by the senior judge appointed by the Leaders of the District Court, while the interim replacement replacements are not regulated in the Mentawai Islands Regency RHoR Rules so Guide to the pronunciation of the oath of the RHoR Leader Substitute for interim time guided by other RHoR leaders.
