Abstract
Hak tanggungan merupakan perlindungan hukum bagi kreditur apabila debitur tidak dapat melakukan kewajibannya untuk melunasi hutang kepada kreditur. Pelunasan hutang kreditur dilakukan dengan cara penjualan objek jaminan hak tanggungan melalui pelelangan umum. Dalam proses lelang yang telah di lakukan akan menimbulkan akibat hukum yaitu peralihan hak objek lelang dari penjual kepada pemenang lelang tujuan dari. Penelitian ini di lakukan untuk mengetahui pelaksanaan lelang eksekusi hak tanggungan pada Kantor Pelayanan Kekayaan Negara dan Lelang (KPKNL) Pekanbaru, akibat hukum bagi pemenang lelang yang tidak bisa menguasai objek lelang eksekusi hak tanggungan, dan perlindungan hukum terhadap pemenang lelang eksekusi hak tanggungan. Metode penelitian yang di gunakan adalah yuridis empiris dengan spesifikasi penelitian deskriptif analitis. Data primer dan data sekunder di peroleh melalui studi kepustakaan dan survei lapangan dengan alat pengumpul data berupa wawancara, hasilnya di analisa secara kualitatif. Hasil penelitian menunjukkan bahwa pelaksanaan lelang eksekusi hak tanggungan pada KPKNL Pekanbaru di laksanakan berdasarkan Peraturan Mentri Keuangan Republik Indonesia Nomor 27/PMK.06/2016, dan berkaitan dengan Peraturan Mentri Keuangan Nomor 106/PMK.06/2013 tentang perubahan atas Peraturan Menteri Keuangan Nomor 93/PMK.06/2010 tentang petunjuk pelaksanaan lelang. Sehubungan akibat hukum pemenang lelang tidak dapat menguasai objek lelang, maka pemenang lelang dapat mengajukan penetapan pengosongan objek lelang kepada ketua pengadilan negeri setempat. Perlindungan hukum terhadap pemenang lelang eksekusi hak tanggungan secara normatif memang di dukung dengan adanya risalah lelang sebagai akta otentik. Namun, untuk menguasai objek lelang tidak diperoleh kepastian hukum lantaran peraturan perundang-undangan tidak mengatur secara eksplisit perlindungan terhadap pihak ketiga; si pemenang lelang. Legal Protection of Winners of Auction of Mortgage Rights Auction at the State Wealth Service Office and Auction (KPKNL) Pekanbaru By: Yenti Murni Student of Master Program of Notarization/Notary Faculty of Law, Andalas University of Padang Abstract The mortgage is legal protection for the creditor if the debtor cannot perform its obligation to pay off the debt to the creditor. Repayment of creditor debt is made by selling the object of guarantee of mortgage rights through public tender. The auction process will result in legal effect, namely the transfer of rights of auction object from the seller to the auction winner. This research is aimed to know the execution auction of mortgage rights at State Property Office and Auction (KPKNL) Pekanbaru, the legal consequences for the auction winner who can not control the auction object of mortgage execution, and the legal protection to a winner of the auction of mortgage execution. The research method used is juridical empirical with analytical, descriptive research specification. Primary and secondary data were obtained through a literature study and a survey. Data collection tools are interviews. Data obtained is analyzed quantitatively. The result of the research shows that the execution auction of mortgage rights at KPKNL Pekanbaru is implemented based on the Regulation of Minister of Finance of the Republic of Indonesia Number 27 / PMK.06 / 2016, and is related to Regulation of the Minister of Finance Number 106 / PMK.06 / 2013 regarding the amendment to Regulation of the Minister of Finance Number 93 / PMK.06 / 2010 concerning the instruction of auction implementation. In respect of the legal consequences of the auction winner being unable to control the auction object, the auction winner may apply for the auction of auction object to the head of the local district court. The auction treaty normatively supports the legal protection of the winner of the auction as an authentic deed. However, a legal certainty to control the object of an auction is not obtained as the law does not explicitly regulate the protection of the winner of the auction.
