Abstract

Sengketa rokok kretek antara Indonesia dan Amerika Serikat pada tahun 2010-2014 ditangani oleh panel DSB WTO. Sengketa didorong oleh Amerika Serikat yang mendiskriminasikan rokok kretek Indonesia dalam Family Smoking Prevention and Tobacco Control Act, yang mana kedua negara sepakat untuk membawa sengketa tersebut ke DSB. Penelitian ini bertujuan untuk memahami peran WTO dalam implementasi hasil keputusan sengketa rokok kretek antara Indonesia dan Amerika Serikat. Sengketa dapat berakhir dengan Amerika Serikat menawarkan kesepakatan kepada Indonesia berupa MoU. Penyusunan skripsi ini menggunakan konsep organisasi internasional, dengan pendekatan rule adjudication sebagai salah satu fungsi WTO sebagai sebuah organisasi internasional dan metode penelitian yang didasarkan pada tipe kualitatif deskriptif dengan sumber data sekunder. Hasil penelitian menunjukkan bahwa WTO memainkan perannya sebagai rule adjudication dengan menyarankan compensation yang pada akhirnya menghasilkan Mutual Agreed Settlement berbentuk MoU agar hasil keputusan DSB dapat diimplementasikan oleh negara yang bersengketa sehingga sengketa dinyatakan berakhir oleh kedua belah pihak. Kata Kunci: Mutually Agreed Solution, Kompensasi, Sengketa Perdagangan, World Trade Organization, Rule Adjudication ABSTRACT Clove cigarette disputes between Indonesia and the United States in 2010-2014 are handled by the DSB panel in WTO. Disputes are encouraged by the United States who want to reduce the use of clove cigarettes among young people. This study aims to analyse the role of the WTO in the implementation of the dispute resolution result of clove cigarettes between Indonesia and the United States. The disputes ended with the United States offering an agreement to Indonesia in the form of MoU. The preparation of this thesis uses the concept of international organization, with the approach of rules adjudication as one of the functions of WTO as an international organization and research method based on qualitative descriptive type with secondary data source. The results show that the WTO plays its role as a rule adjudication by suggesting compensation which ultimately results in Mutual Agreed Settlement in the form of MoU so that the decision of DSB can be implemented by the disputing country so that the dispute is ended by both parties.
