Abstract

Penelitian ini bertujuan untuk mendeskripsikan Fungsi UNHCR ¬¬(United Nation High Commissioner for Refugees) dalam penanganan pengungsi dan pencari suaka di Indonesia pada tahun 2010-2104. Indonesia tidak memiliki aturan yang baku mengenai penanganan pengungsi dan pencari suaka, kondisi ini diakibatkan karena Indonesia tidak ikut meratifkasi Konvensi 1951 dan Protokol 1967 tentang pengungsi yang mengatur tentang mekanisme penangangan pengungsi dan pencari suaka yang mengabaikan hak-hak dasar perlindungan pengungsi dan pencari suaka yang berlaku secara Jus Cogens. Penelitian ini menggunakan metode penelitian kualitiatif dengan menganalisa berbagai upaya yang dilakukan UNHCR dalam menangani pengungsi dan pencari suaka berdasarkan enam fungsi IGO yang diungkap ole oleh Margareth P Karns dan Caren A Mingst yaitu Informational, forum, normative, rule creation, rule supervision dan operational. Penelitian ini menemukan upaya UNHCR dalam penanganan pengungsi di Indonesia adalah informational mengumpulkan dan menyebarkan informasi dan data melalui proses Refugees Status Determination (RSD), Forum, dengan menggunakan Bali Process tentang penanganan pergerakan manusia dikawasan Asia-Pasifik, Normative melalui proses sosialisasi norma-norma berlaku yang sesuai dengan mandat UNHCR, Rule Creation, memberikan 10 Point Plan of Action in Addressing Refugee Protection and Mixed Migration in Indonesia sebagai acuan aturan penanganan pengungsi di Indonesia, Rule Supervision, Peraturan Ditjen Imigrasi Nomor IMI-1489.um.08.05 Tahun 2010 yang mengatur kerjasama Indonesia dan UNHCR, dan Operational yang memberikan bantuan langsung kepada pengungsi dan pencari suaka baik langsung maupun bantuan teknis. Kata Kunci: UNHCR, Pengungsi, Pencari Suaka, Indonesia, IGO. ABSTRACT The purpose of this research is to describe the efforts of the UNHCR (United Nation High Commissioner for Refugees) dealing with the refugees and asylum seekers in Indonesia from 2010 up until 2014. Indonesia does not have a regulation which deals with refugees and asylum seekers; this condition is due to the fact that Indonesia did not participate in the ratification of the 1951 convention, and 1967 protocol on the refugees which regulates the mechanism in controlling the refugees and asylum seekers that does not pay attention to the fundamental rights of the refugees and asylum seekers in accordance to Jus Cogens. This research utilizes the qualitative method by analyzing the efforts made by the UNHCR in dealing with refugees and asylum seekers based on the six functions of IGO (International Governmental Organization) stated by Margareth P Karns and Caren A Mingst which is Informational, forum, normative, rule, creation, rule supervision, and operational. This research discovers the fact that the efforts made by UNHCR in dealing with refugees in Indonesia is informational which gathers and spreads the data through a process called the refugee status determination (RSD), forum, through Bali Process about handling human movement in Asia-Pacific, normative through the process of socialization the norms which exist and applies to the mandate of the UNHCR, Rule Creation, which gives the 10 Point Plan of Action in Addressing Refugee Protection and Mixed Migration in Indonesia as a reference for rules which control the refugees and asylum seekers in Indonesia, Rule Supervision, the Immigration Centre rule: IMI-1489.um.08.05 in 2010 states the rules of cooperation between Indonesia and UNHCR and operation contributes to the direct help to the refugee, whether it is direct or technical.
