Abstract
Kebutuhan rumah masih sulit untuk diperoleh, walaupun pemerintah selalu bergiat dan berusaha melaksanakan pembangunan perumahan untuk memenuhi kebutuhan rakyat. Di tengah keterbatasan kemampuan pemerintah, menimbulkan peluang pelaku usaha untuk memenuhi kebutuhan perumahan masyarakat, yang biasa disebut sebagai pengembang. Pengembang diwajibkan untuk memberikan perlindungan hukum konsumen seperti yang diatur dalam Pasal 4 Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen (UU-PK). Penelitian ini akan membahas perlindungan hukum konsumen dalam perjanjian jual beli rumah melalui sistem pesan-bangun, proses pembangunan rumah yang dijual melalui sistem pesan-bangun kepada konsumen, dan perlindungan hukum konsumen atas pembangunan rumah melalui sistem pesan-bangun pada Perumahan Graha Mahrum Regency di Kabupaten Kampar. Metode pendekatan yang digunakan adalah yuridis empiris, dengan data yang diperoleh melalui studi pustaka dan wawancara. Metode analisa data yang digunakan adalah deskriptif analitis. Perlindungan hukum konsumen dalam perjanjian jual beli rumah dengan sistem pesan-bangun pada Perumahan Graha Mahrum Regency telah dimulai dengan adanya perjanjian jual beli rumah berupa Perjanjian Pengikatan Jual Beli (PPJB) antara pengembang dengan konsumen, pada saat pelaksanaan pembangunan rumah dengan melibatkan konsumen sebagai salah satu pengawas pelaksanaan pekerjaan, dan setelah selesainya pembangunan rumah yang dilanjutkan dengan serah terima bangunan rumah kepada konsumen. Pengembang memberikan jaminan atas konstruksi rumah pada saat serah terima kepada konsumen ditambah dengan adanya masa pemeliharaan selama 14 (empat belas) hari. PT. Eka Mahrum Mandiri telah berupaya melakukan kewajibannya seperti perbaikan konstruksi rumah yang mengalami kerusakan dalam masa pemeliharaan. Selain itu, hak dan kewajiban masing-masing pihak juga telah sesuai dengan Pasal 4, 5, 6, dan 7 UU-PK. Akan tetapi khusus untuk masa pemeliharaan rumah, belum sesuai dengan Keputusan Menteri Negara Perumahan Rakyat Republik Indonesia Nomor 09/KPTS/M/1995, yang menetapkan masa pemeliharaan selama 100 (seratus) hari. Kata kunci : Perlindungan hukum, konsumen, jual beli rumah, pesan-bangun LEGAL PROTECTION OF CONSUMERS IN PURCHASING OF HOUSES THROUGH RESERVATION SYSTEM OF GRAHA MAHRUM REGENCY IN KAMPAR DISTRICT (Roni Trino Marta, Post Graduate of Notary Program Faculty of Law, Andalas University, Thesis, 2016) ABSTRACT The need of shelters in Indonesia is still far from being fulfilled by the government although some projects of house constructions have been carried out by the government to meet the society need. In the limited capability of government, it has created a business prospect for entrepreneurs to fulfill the demand of housing as they are commonly called as developers. Developers are obliged to provide legal protection of consumers as stated in the Article number 4 of Law No. 8/1999 on Consumer Protection states. This study discusses the legal protection of consumers in the sale and purchase protection of consumers in the sale and purchase agreement of the house through the reservation, and legal protection of consumers on the construction of the house through reservation of Graha Mahrum Regency, in Kampar Regency. The method used was empirical juridical by collecting data was obtained through literature reviews and interviews. The descriptive analytical method was applied to analyze the data. The legal protection of consumers in the purchase agreement of housing through reservation of Graha Mahrum Regency is commenced with the sale and purchase agreement of house between developers and consumers. Consumers are also involved as the supervisor during the construction to monitor the implementation of the work and after the construction of the house has been completed and handed over to the consumers. After that the Developers give warranty of the house construction at the time of handover and then they would provide maintenance services within 14 (fourteen) days after the handover. PT. Mahrum Eka Mandiri has carried out its obligations such as repairing the houses’ damages during the maintenance period. Furthermore, the rights and obligations of each party have referred to the Article number 4, 5, 6, and 7 of Law-Consumer Protection. However, it is found that the implementation of the house maintenance has not been fully referred to the Minister of Housing Decree of the Republic of Indonesia number 09/KPTS/M/1995, which states that the maintenance period of the house is within 100 (one hundred) days.
