Abstract

PELAKSANAAN TANGGUNG JAWAB PENDAFTARAN JAMINAN FIDUSIA SECARA ELEKTRONIK (ONLINE SYSTEM) OLEH NOTARIS DI KABUPATEN AGAM (Slamet Ariadi, NIM. 1820123020, Pembimbing I : Dr. Dahlil Marjon, SH., MH Pembimbing II : Dr. Delfianti, SH., MH, Program Studi Magister Kenotariatan, Program Pasca Sarjana, Fakultas Hukum Universitas Andalas, vi + 119 Halaman, 2022) ABSTRAK Tanggungjawab yang disandang oleh seorang notaris, maka jabatan notaris dijalankan oleh mereka yang selain memiliki kemampuan ilmu hukum yang memadai harus pula dijabat oleh mereka yang beretika dan berakhlak tinggi. Namun notaris dihadapkan pada beberapa tantangan dalam mewujudkan tanggung jawabnya itu.Tidak lengkapnya data masih merupakan masalah dalam pembuatan akta dan pendaftaran Jaminan Fidusia. Untuk mengetahui segala sesuatu yang berhubungan dengan pendaftaran Jaminan Fidusia serta tanggung jawab notaris dalam pendaftaran tersebut, maka penulisan hukum ini diberi judul “Pelaksanaan Tanggung Jawab Pendaftaran Jaminan Fidusia Secara Elektronik (Online System) Oleh Notaris Di Kabupaten Agam. Metode Penelitian yang digunakan dalam penelitian ini adalah Yuridis Empiris, yaitu suatu pendekatan yang dilakukan untuk menganalisis sejauh mana suatu peraturan perundangan hukum berlaku efektif. Hasil Penelitian ini adalah (1). Pelaksanaan Tanggung Jawab Pendaftaran Jaminan Fidusia Secara Elektronik (Online System) oleh Notaris di Kabupaten Agam yaitu notaris tetap bertanggung jawab atas akta Jaminan Fidusia secara online yang dibuatnya sampai akhir hayat meskipun notaris tersebut telah berakhir masa jabatannya. (2) Kendala Pelaksanaan Pendaftaran Jaminan Fidusia Secara Elektronik (Online System) oleh Notaris di Kabupaten Agam yaitu terdapat beberapa faktor yang menjadi kendala Pelaksanaan Pendaftaran Jaminan Fidusia Secara Elektronik (Online System) oleh Notaris di Kabupaten Agam, yaitu a) Faktor Internal dalam Pelaksanaan Pendaftaran Akta Perjanjian Jaminan Fidusia Secara Online yaitu Pelaksanaan pendaftaran akta perjanjian Jaminan Fidusia secara online akibat terjadi kesalahan input oleh notaris. b) Faktor Eksternal dalam Pelaksanaan Pendaftaran Akta Perjanjian Jaminan Fidusia Secara Online yaitu Faktor eksternal dalam pembuatan akta Jaminan Fidusia oleh notaris yang berkaitan dengan Credit Approval Memorandum (CAM) pemberi fidusia pada umumnya ditemukan bahwa debitur bukanlah pemilik barang sebagaimana yang tertera di dalam Buku Pemilik Kendaraan Bermotor (BPKB) sehingga hal ini bertentangan dengan Undang-Undang Jaminan Fidusia (UUJF) No. 42 Tahun 1999. Kata Kunci: Tanggung Jawab Notaris, Pendaftaran Jaminan Fidusia   IMPLEMENTATION OF RESPONSIBILITY FOR REGISTRATION OF FIDUCIARY GUARANTEE ELECTRONICALLY (ONLINE SYSTEM) BY NOTARIES IN AGAM DISTRICT (Slamet Ariadi, NIM. 1820123020, Mentor I : Dr. Dahlil Marjon, SH., MH Mentor II : Dr. Delfianti, SH., MH, Master of Notary, Post-Graduate Program, Faculty of Law Andalas University, vi + 119 Pages, 2022) ABSTRACT The responsibility that is carried by a notary, then the position of a notary is carried out by those who in addition to having adequate legal knowledge must also be held by those who have high ethics and morals. However, notaries are faced with several challenges in realizing their responsibilities. Incomplete data is still a problem in making the deed and registration of fiduciary guarantees. To find out everything related to the registration of fiduciary guarantees and the responsibilities of a notary in the registration, the writing of this law is entitled "Implementation Of Responsibility For Registration Of Fiduciary Guarantee Electronically (Online System) By Notaries In Agam District. The research method used in this research is Empirical Juridical, which is an approach taken to analyze the extent to which a legal regulation is effective. The results of this study are (1). Implementation of Responsibilities for Registration of Fiduciary Guarantees Electronically (Online System) by Notaries in Agam Regency, namely the notary remains responsible for the online fiduciary guarantee deed he made until the end of his life even though the notary's term of office has ended. (2) Obstacles in the Implementation of Electronic Fiduciary Guarantee Registration (Online System) by Notaries in Agam Regency, namely there are several factors that become obstacles in the Implementation of the Electronic Fiduciary Guarantee Registration (Online System) in Agam Regency, namely a) Internal Factors in the Implementation of Deed Registration Online Fiduciary Guarantee Agreement, namely the implementation of online registration of a fiduciary guarantee agreement deed due to an input error by a notary. b) External Factors in the Implementation of Online Registration of Fiduciary Guarantee Agreement Deeds, namely external factors in the making of a fiduciary guarantee deed by a notary related to the Credit Approval Memorandum (CAM) of the fiduciary grantor in general it is found that the debtor is not the owner of the goods as stated in the Vehicle Owner's Book Motorized (BPKB) so that this is contrary to the Fiduciary Guarantee Law (UUJF) No. 42 of 1999.
