Abstract

ABSTRACT Intellectual property rights are exclusive rights held by a person or legal entity who creates something in the use and benefit from intellectual property that owned or created. Copyright is part of the intellectual property rights governing the creation in the form of literature, drama, music, sound recordings, films, radio, televison system, papers, and other art work. The regulation of copyright is regulated in the TRIPS (Trade Related Aspects of Intellectual Property Rights) Indonesia is a country that participated in the TRIPs make Indonesia sholud response seriously in violations that occurred in Indonesia. To find out more specific authors formulate three problems: first, forms of regulation of copyright to songs and music by TRIPs, second, forms of copyright infringement against songs and music, third, form of prevention of copyright infringement against music and song. The method used is a normative legal research methods. And the research is descriptive research. The type of data are primary data and secondary data. Primary data is data obtained directly from the source while secondary data is data that is the data that give explaination which taken from the literature consisting of primary law material which is legal materials whose contents are binding like conventions, laws, and regulations that exist. Secondary law are ingredients that provide an explanation for the primary legal materials in the form of books written by scholars, literature-literature. Tertiary legal materials, the materials that support the understanding of primary and secondary legal materials. From the discussions that exist among other forms of copyright arrangements contained in TRIPS is TRIPs is a convention adopting other conventions related to copyright, such as the Rome Convention, the Paris Convention, the berne convention and other conventions. As a country participating in the TRIPs Indonesia has an obligation to adjust its national legislation with TRIPs. Copyright infringement on the song and music among others a violation of moral rights, such as the anonymous creators in general use and change the title or change the content of the song and music. violation towards the right of the economy creator such as songs and music piracy, plagiarism songs and music, and the use of songs and music for the commercial without approval by the copyright holder.
