PENANGANAN TINDAK PIDANA PEMILU TAHUN 2019 DAN TINDAKPIDANA PILKADA TAHUN 2020 OLEH SENTRA PENEGAKANHUKUMTERPADU DI KABUPATEN LIMAPULUH KOTA Oleh:Hadi Saputra(1920112047) (Dibawah bimbingan: Dr. Yoserwan, S.H., M.H.,LL.M. dan Dr. Khairul FahmiS.H.,M.H., ) ABSTRAK Penegakan hokum pidana pemilu dan pilkada merupakan instrument untuk mengawal pelaksanaan Pemilu dan Pilkada yang jujur dan adil.Penegakan hukum pidana dilaksanakan oleh Gakkumdu. Adapun Sentra Gakumdu ada dipusat maupun didaerah Kabupaten/kota yang ditangani oleh Sentra Gakumdu Lima Puluh Kota yang menangani mulai dari laporan dan temuan hinggapemeriksaan oleh pengadilan, di Kabupaten lima puluh kota dalam Pemilu 2019 ada masuk 4(empat) temuan, dan 6(enam) dari laporan,atas dugaan pelanggaran tindak pidana pemilu tahun 2019 dan untuk pilkada tahun 2020 diKabupaten Lima Puluh Kota, terdapat 6 (enam) kasus temuan dan hanya 1 (satu) kasus yang sampai ke Pengadilan, berhubungan dengan Sentra Penegakan Hukum Terpadu (Gakkumdu) yang terdiri atas unsure Bawaslu,Polri,dan Kejaksaan dalam penanganan tindak pidana pemilu dan pilkada serta pelaksanaan fungsi penyelidikan, penyidikan dan penuntutan. Adapun rumusan masalah penelitian ini adalah, bagaimana pelaksanaan penanganan tindak pidana pemilihan umum tahun 2019 oleh Sentra Penegakan Hukum Terpadu (Gakkumdu) di Kabupaten Lima Puluh kota?;bagaimanakah pelaksanaan penanganan tindak pidana pemilihan kepala daerah tahun 2020 oleh Sentra Penegakan Hukum Terpadu (Gakkumdu)di Kabupaten Lima Puluh kota?.Metode penelitian hokum yang digunakan adalah penelitian hokum empiris,Adapun data penelitian iniyaitu primer dan sekunder, dimana data primer yaitu berupa wawancara, Focus Group Discussion (FGD) dan observasi. Sedangkan data sekunder berupa ketentuan peraturan perundangan berupa bahan hokum primer dan sekunder dan tersier. Berdasarkan hasil penelitian dan pembahasan diperoleh hasil sebagai berikut :pertama penanganan pidana pemilu oleh SentraGakkumdu Lima Puluh Kota terdapat:4 kasus berasal dari temuan dan 6 kasusberasal dari laporan. Hanya 1 kasus yang berasal dari temuan dengan Nomor 005/TM/PL/03.10/IV/2019 atas nama terlapor Yeni Zafitri yang telah diproses mulai dari tahap penerimaan temuan atau laporan hingga tahap pemeriksaan oleh pengadilan dan telah berkekuatan hokum tetap berdasarkan Putusan Nomor:101/Pid.Sus/2021/PT.Pdg. kedua, penanganan pidana pilkada oleh Sentra Gakkumdu Lima Puluh Kota dari 6kasus, hanya 1 kasus berasal dari temuan yang dinaikkan ketahap penyidikan hingga pemeriksan oleh pengadilan.Temuan tersebut dengan Nomor 005/TM/PL/03.10/IV/2019 atas nama terlaporWisna Lendrawati yang telah diproses mulai dari tahap penerimaan temuan atau laporan hingga tahap pemeriksaan oleh pengadilan dan telah berkekuatan hokum tetap berdasarkan Putusan Nomor:19/Pid.Sus/2021/PT.Pdg.. In the context of holding General Electionsand Regional HeadElectionse very5 (five) year saspartofthe democratic system in Indonesia ,itispossible that ther ewill beviolations related to the General Election and Regional Head Election. Violations that occur can becarrie dout byt heorganizer sof the General Electionand/orRegional HeadElection, candidate pairs in the General Election and Regional Head Election aswell as a successful team or volunteers from certain pairs of candidates. Criminalviolations of the 2019 general election that occurred in the Lima Puluh Kota Regency,Sumatera Barat province,thereare 10 (ten) cases.Mean while,thereare 6(six) caseso fall egedviolation softhe 2020 regional headelections thato ccurred in Lima Puluh Kota Regency, which were sourced from the findings of. Basedon this, thefor mulation of the problemin this writing ,namely: (1) How is the handling of criminal actsin the 2019 generalelection by the Integrated Law Enforcement Centerin the Lima Puluh Kota Regency;(2)Howis the handlingof thecriminalactof the 2020 Regional Headelection by the Integrated Law Enforcement Centerin Lima Puluh Kota Regency.There searc husedin this article sempirical legalresearch where the data areobtained fromt hecommunity.From there sult softhe study,itwas concluded that:Intermsof handlinggener alelection crimes by the Lima Puluh Kota Integrated Law Enfor cement Centeroutof 10(ten) cases,only1(one)case originated from finding sthat were raise dtothe stag eof investigation until examination by the court where evidence was found. evidence of violations of criminal acts of generalelectio nasdescrib edinarticle 516of Law Number 7of 2017 concerning generalelections, namely by imprisonment for 2(two) months and a fineof Rp. 5,000,000 (fivemillionrupiah)provid edthat the fineis not paidisreplaced withimpris on mentfor2(two)months.Then,intermsof han dlingthecrime of Regional Head Elections by the Lima Puluh Kota Integrated Law Enforcement Centerouto f6(six) cases,only1(one) cases tems from finding sthat arerai sedtot heinvestigation stageuntil examination byt hecourtas regulatedin the General Election Commission Regulation.
