Abstract

Intellectual Property Rights have an increasingly decisive role to accelerate the pace of national development, especially in the era of globalization. Law No. 28 of 2014 on Copyright, have established forms of copyright infringement, among others, a person who acts without permission from the creator or copyright holder to reproduce, perform, transmit via cable, copy, create, multiply, broadcast, rent, exporting or importing copyrighted works. The problems of this study are (1) How will the copyright on songs by Act No. 28 of 2014 on Copyright? (2) How does the process of implementing criminal witness for copyright infringement song according to Law No. 28 Year 2014 on Copyright ?. The method used in this research is normative juridical method. Type of research is descriptive. Data sources are primary data and supported by secondary data. Based on this research, the authors can conclude first, On copyrighted songs regulated in Law Number 28 Year 2014 on Copyright. Unadang Act stipulates that Copyright is the exclusive right of the creator that arise automatically based on the declarative principle after an invention is embodied in a tangible form without reducing restrictions in accordance with the provisions of the legislation. Copyright is one part of the intellectual property that has the scope of protected objects the most comprehensive, because it covers the science, art and literature in which also includes a computer program. Secondly, Act No. 28 of 2014 concerning the regulation, Protection Copyright performed with a longer time in line with the application of the rules in various countries so that a period of protection of Copyright in the specific field applied during the life of the author plus 70 (seventy) years after his death, and Protection were better against the economic rights of the creator and / or related rights owners, including limiting the transfer of economic rights in the form of true sale. This study has advised several things, including; It is important to do a thorough dissemination to law enforcement officials regarding the substance of the Act No. 28 of 2014, and.
