Abstract

KEBERADAAN PERATURAN KEBIJAKAN SEBAGAI PRODUK HUKUM WALIKOTA DALAM PENYELENGGARAAN PEMERINTAHAN DAERAH (Nofiandi Amir, 1920112070, Program Studi Magister Kenotariatan Fakultas Hukum Universitas Andalas Padang, 92 hlm ) ABSTRAK Surat edaran dikategorikan sebagai instrumen administratif yang bersifat internal. Surat edaran ditujukan untuk memberikan petunjuk lebih lanjut mengenai suatu norma peraturan perundang-undangan yang bersifat umum. Surat edaran yang dikeluarkan merupakan wujud menggambil keputusan dari Walikota dalam melakukan tanggungjawabnya sebagai kepala daerah. Untuk itu penulis tertarik membahas 1) Keberadaan Peraturan Kebijakan sebagai salah satu Produk Hukum Walikota dalam Penyelenggaraan Pemerintahan Daerah, 2) Pertimbangan diterbitkannya Peraturan Kebijakan oleh Walikota. Metode penelitian yang digunakan penulis adalah yuridis normatif. Metode yuridis normatif yaitu penelitian yang dilakukan terhadap data sekunder dengan fokus kegiatan penelitian adalah penelitian terhadap asas-asas hukum, penelitian terhadap sistematika hukum, dan penelitian terhadap taraf sinkronisasi hukum. Dari hasil penelitian dan pembahasan 1) Keberadaan peraturan kebijakan sebagai salah satu produk hukum walikota dalam penyelenggaraan pemerintahan daerah adalah keberadaan peraturan kebijakan ini penting dan perlu dilakukan oleh pemerintah dalam penyelengggaran pemerintahan di daerah karena peraturan kebijakan ini berisikan tindakan pemerintah kepada masyarakat atau bentuk yang dipilih oleh pemerintah yang merupakan bentuk dari pengalokasian nilai-nilai kepada masyarakat untuk mencapai tujuan pemerintahan , tindakan pemerintah untuk mengatasi masalah-masalah pemerintah untuk melindungi kepentingan masyarakat baik di bidang politik, hukum, ekonomi dan sosial dan 2) Pertimbangan diterbitkannya Peraturan Kebijakan oleh Walikota adalah untuk mengatasi permasalahan dalam masyarakat baik dalam bidang ekonomi, sosial dan hukum seperti penanganan masalah covid, mengoptimalkan penerimaan pajak daerah yang akan diguanakn pemerintah untuk kegiatan pembangunan, disiplin PNS dalam menjalankan tugas dan jabatannya dimana peraturan kebijakan berupa surat edaran yang dikeluarkan walikota ini sebagai pelengkap peraturan perundang-undangan yang berlaku, peraturana kebijakan ini juga sebagai acuan bagi pemerintah , strategi dan kerangka kegiatan yang dipilih atau ditetapkan oleh pemrintah dalam melakukan kegiatan pembangunan di daearh, peraturan kebijakan dibutuhkan karena semakain meluasnya peranan pemerintah dalam kehidupan masyarakat, semakin kompleksnya persoalan ekonomi, sosial dan politik. Kata Kunci : Peraturan Kebijakan , Produk Hukum dan Pemerintahan Daerah THE EXISTENCE OF POLICY REGULATIONS AS MAYOR'S LEGAL PRODUCTS IN THE IMPLEMENTATION OF LOCAL GOVERNMENT (Nofiandi Amir, 1920112070, Notary Masters Study Program, Faculty of Law, Andalas University Padang, 92 pp. ) ABSTRACT irculars are categorized as internal administrative instruments. The circular letter is intended to provide further instructions regarding a general statutory norm. The circular issued is a foothold from the Mayor in carrying out his responsibilities as regional head. For this reason, the authors are interested in discussing 1) The existence of Policy Regulations as one of the Mayor's Legal Products in the Implementation of Regional Government, 2) Considering the issuance of Policy Regulations by the Mayor. The research method used by the author is normative juridical. The empirical juridical method is research conducted on secondary data with the focus of research activities being research on legal principles, research on legal systematics, and research on the level of legal synchronization. From the results of research and discussion 1) The existence of policy regulations as one of the mayor's legal products in the administration of local government is the existence of this policy regulation is important and needs to be carried out by the government in implementing government in the region because this policy regulation contains government actions to the community or the form chosen by the government. government which is a form of allocating values to the community to achieve government goals, government actions to overcome government problems to protect the interests of the community both in the political, legal, economic and social fields and 2) Consideration of the issuance of Policy Regulations by the Mayor is to overcome problems in society both in the economic, social and legal fields such as handling the covid problem, optimizing local tax revenues that will be used by the government for development activities, civil servants discipline in carrying out their duties s and his position where the policy regulations are in the form of circulars issued by the mayor as a complement to the applicable laws and regulations, these policy regulations are also a reference for the government, strategies and activity frameworks chosen or determined by the government in carrying out development activities in the area, policy regulations This is needed because the government's role in people's lives is expanding, the more complex economic, social and political issues are.
