Abstract

ABSTRAK Sebelum penjajah Belanda datang dan memberlakukan sistem hukum kolonial belanda di Indonesia, bangsa Indonesia sudah mengenal dan mempunyai hukumnya sendiri, termasuk hukum yang berkaitan dengan sumber daya agraria. Tanah ulayat merupakan bidang tanah pusaka beserta sumber daya alam yang ada di atasnya dan didalamnya diperoleh secara turun menurun merupakan hak masyarakat hukum adat di Propinsi Sumatra barat yakni garis keturunan ibu (matrilineal). Dalam pendaftaran tanah dimana ada proses yang harus dilalui sebelum semua persyaratan di bawak ke kantor pertanahan di dharmasraya, yang mana dalam proses mengkonversi tahah ulayat juga tidak terlepas dari sengketa yang timbul akibat pendaftaran tanah tersebut. Berdasarkan pemikiran di atas, maka penulis tertarik melakukan penelitian dengan permasalahan, yaitu: 1) Bagaimana proses pembuatan Surat Penguasaan Fisik atas tanah Ulayat Kaum sebagai Alas Hak di Kabupaten Dharmasraya. 2) Bagaimana proses pendaftaran tanah Hak Milik berdasarkan Konversi Tanah Ulayat Kaum. 3) Bagaimana peran Notaris/PPAT dalam proses pendaftaran Hak Milik berdasarkan Konversi Tanah Ulayat Kaum di Kabupaten Dharmasraya. Penelitian ini menggunakan pendekatan yuridis empiris. Data yang digunakan meliputi data primer dan data sekunder, data dikumpul dengan wawancara dan studi dokumen, kemudian dianalisis secara kualitatif. Dari hasil penelitian, maka di peroleh simpulan, yaitu 1. Proses pembuatan surat pernyataan penguasaan fisik atas Tanah Ulayat Kaum sebagai alas hak, dengan cara mengurus terlebih dahulu Ranji anggota kaum, Surat Pernyataan Penguasaan Fisik Bidang tanah, 2. Proses pendaftaran tanah hak milik berdasarkan konversi tanah ulayat kaum, dilakukan berdasarkan Peraturan perundang-undangan yang berlaku, dan 3. secara teori tidak ada peran Notaris/PPAT dalam hal Konversi tanah ulayat kaum menjadi Hak Milik. Kata Kunci: Konversi, Hak Atas Tanah, Tanah Ulayat, Hak Milik   ABSTRACT Before the Dutch colonialists came and enforced the Dutch colonial legal system in Indonesia, the Indonesian people already knew and had their own laws, including those related to agrarian resources. Ulayat land is a parcel of heirloom land along with the natural resources on it and in which it is derived from generations is the right of the customary law community in West Sumatra Province, namely the maternal lineage (matrilineal). In land registration, there is a process that must be passed before all the requirements are brought to the land agency office in Dharmasraya, which in the process of converting ulayat tahah is also inseparable from disputes arising from the land registration. Based on the above thoughts, the authors are interested in conducting research with the problems, namely: 1) How is the process of making a Physical Tenure of Land of Ancestral Tribe as a primary basis for rights in Dharmasraya Regency. 2) What is the process of registering right of ownership of land based on the conversion of land to ulayat Kaum. 3) What is the role of the Notary / PPAT in the process of registering right of ownership based on the Conversion of Ancestral Tribe’s Land in Dharmasraya Regency. The research methods used an empirical juridical approach. The data used include primary data and secondary data, the data were collected by interview and study of documents, then analyzed qualitatively. The results of the researchs, conclusions are obtained, as follows: 1. The process of making a statement of physical control over Ancestral Tribe’s Land as a basis of rights, by first taking care of Ranji members of the clan, a Statement of Physical Mastery of Land Plots, 2. The process of registering property rights is based on conversion of ulayat clan land, is carried out based on the prevailing statutory regulations, and 3. theoretically there is no notary / PPAT question in the case of conversion of ulayat clan land to property rights.
