Abstract

EFEKTIVITAS PENGAWASAN MAJELIS PENGAWAS DAERAH TERHADAP NOTARIS DALAM MENJALANKAN JABATANNYA DI KOTA PADANG (Jill Andriza, 1820122016,Pasca Sarjana Fakultas Hukum Universitas Andalas, 138halaman, 2021) ABSTRAK Notaris merupakan pejabat umum yang mandiri yang memiliki kewenangan dalam membuat akta otentik, sepanjang untuk pembuatan akta tersebut tidak dikecualikan kepada pejabat lain. Untuk menjadi pejabat umum seperti Notaris tidaklah mudah harus memenuhi semua persyaratan untuk menjadi seorang Notaris. Semua persyaratan itu dituangkan dalam UUJN.Begitu juga dengan tanggung jawab Notaris yang berkaitan dengan profesi hukum tidak dapat dilepaskan pada pendapat bahwa dalam melaksanakan jabatannya tidak dapat dilepaskan dari keagungan hukum itu sendiri, sehingga Notaris diharapkan bertindak untuk merefleksikan hal tersebut di dalam pelayanan kepada masyarakat.Dalam praktek pelaksanaan tugas Notaris di kota Padang masih ada Notaris yang setelah tidak menjalankan jabatannya secara baik sebagaimana diatur dalam UUJN maupun dari peraturan Kode Etik Notaris.Dari segala permasalahan ini tidak luput dari pengawasan oleh Majelis Pengawas Daerah (MPD). Disinilah Majelis Pengawas Daerah menjalankan fungsinya dan dapat memberikan sanksi hukum maupun pembinaan terhadap Notaris yang tidak menjalankan jabatannya secara nyata. Rumusan permasalahan dalam tesis ini yaitu, 1. Apakah faktor-faktor yang menyebabkan terjadinya pelanggaran oleh notaris dalam menjalankan jabatannya di kota padang?2. Bagaimana efektivitas pengawasan majelis pengawas notaris terhadap pelanggaran yang dilakukan oleh notaris dalam menjalankan jabatannya di kota padang? Penelitian ini merupakan penelitian yuridis empiris dengan menggunakan dara primer dan data sekunder. Penelitian ini bersifat deskriptif. Hasil penelitian menunjukkan bahwa berdasarkan hasil pengawasan Masih ditemukan ketidak patuhan beberapa notaris di Kota Padang dalam mematuhi ketentuan Undang-Undang Jabatan Notaris mengenai kantor.Faktor-faktor yang menyebabkan terjadinya pelanggaran oleh notaris dalam menjalankan jabatannya di kota padang yaitu, faktor psikologis, faktor keadaan, faktor ekonomis, faktor kesibukan, faktor minat, faktor ketidak mengertian, faktor ketidak pedulian, selain iu juga terdapat faktor-faktor yang menyebabkan pelanggaran atas pelaksanaa tugas jabatan notaris. Efektivitas pengawasan majelis pengawas notaris terhadap pelanggaran yang dilakukan oleh notaris dalam menjalankan jabatannya di kota padang sudah berjalan dengan baik. Pelaksanaan pengawasan yang dilakukan oleh Majelis Pengawas Daerah di Kota Padang dilakukan dengan dua cara yaitu Pemeriksaan ditempat dan pemeriksaan atas dasar adanya laporan masyakarat.Berdasarkan hasil pengawasan Masih ditemukan ketidak patuhan beberapa notaris di Kota Padang dalam mematuhi ketentuan Undang-Undang Jabatan Notaris ini terbukti dengan adanya ditemukan pelanggaran pada saat pemeriksaan di tempat yang dilakukan oleh MPD dan juga adanya laporan masyarakat terhadap pelanggaran yang dilakukan oleh Notaris. Untuk perbaikan ke depanperluhendaknya Majelis Pengawas Daerah diberikan fasilitas yang memadai untuk dapat memaksimalkan pengawasannya terhadap notaris dan perlu dilakukan sosialisasi kepada masyarakat di Kota Padang tentang keberadaan Majelis Pengawas Daerah Kata Kunci: Efektivitas, Pengawasan, dan Majelis Pengawas Daerah. HE POWER OF THE POWER OF THE SUPERVISION EFFECTIVENESS OF THE REGIONAL SUPERVISORY ASSEMBLY ON THE NOTARY IN PERFORMING ITS POSITION IN THE CITY OF PADANG (Jill Andriza, 1820122016, Post-Graduate of the Faculty of Law, Andalas University, 137 pages, 2021) ABSTRACT Notaries are independent public officials who have the authority to make authentic deeds, as long as other officials are not excluded from making the deed. To become a public official like a Notary is not easy, you have to fulfill all the requirements to become a Notary. All requirements are stated in UUJN. Likewise, the responsibilities of a Notary related to the legal profession cannot be separated from the opinion that in carrying out his position cannot be separated from the greatness of the law itself, so that the Notary is expected to act to reflect this in his service to the community. In the practice of carrying out the duties of a Notary in the city of Padang, there are still Notaries who after not carrying out their positions properly as stipulated in the UUJN and from the regulations of the Notary Code of Ethics. This is where the Regional Supervisory Council carries out its functions and can provide legal sanctions and guidance to Notaries who do not carry out their positions in real terms. The formulation of the problems in this thesis are, 1.What are the factors that cause violations by notaries in carrying out their positions in the city of padang? 2. How is the effectiveness of the supervision of the notary supervisory board against violations committed by notaries in carrying out their positions in the city of Padang?This research is an empirical juridical research using primary and secondary data. This research is descriptive. The results of the study indicate that based on the results of supervision, there are still non-compliance of several notaries in the city of Padang in complying with the provisions of the Notary. The factors that cause violations by notaries in carrying out their positions in the city of Padang are psychological factors, state factors, economic factors, busyness factors, interest factors, ignorance factors, ignorance factors, besides that there are also factors that cause violations. for carrying out the duties of a notary public. The effectiveness of the supervision of the notary supervisory board against violations committed by the notary in carrying out his position in the city of Padang has been going well. In the implementation of supervision, most of the supervision of the Regional Supervisory Council in the City of Padang conducts supervision on the basis of public reports. Based on the results of supervision, there are still non-compliance of several notaries in the city of Padang in complying with the provisions of the Notary Position Act, this is proven by found a violation at on site inspection by regional supervisory council (MPD) and also from community report about violation committed by a notary. For future improvementsthe Regional Supervisory Council should be provided with adequate facilities to maximize its supervision of notaries and it is necessary to disseminate information to the public in the City of Padang about the existence of the Regional Supervisory Council.
