Kurnia Warman, S.H.,M.Hum dan Dr. Azmi Fendri, S.H.,M.Kn ABSTRAK Sengketa pertanahan adalah perselisihan antara orang perorangan, badan hukum, atau lembaga yang tidak berdampak luas. Meskipun begitu sengketa pertanahan dapat mengakibatkan terganggunya stabilitas keamanan, turunnya pertumbuhan ekonomi, dan menciptakan disharmoni sosial kemasyarakatan sehingga menuntut upaya penyelesaian. Penyelesaian melalui pengadilan dirasa kurang efektif bagi karakter masyarakat Solok Selatan, karena menempatkan para pihak pada posisi yang berlawanan, ditambah untuk melaksanakan sidang masyarakat harus Kab. Solok Selatan harus mengeluarkan biaya yang besar dan jarak tempuh yang lama karena ketiadaan Pengadilan Negeri di daerah tersebut. Termasuk kendala keengganan masyarakat menyelesaikan sengketa karena tahapan proses persidangan yang lama dan rumitnya pembuatan materi gugatan, yang dapat saja tidak diterima hakim dalam putusannya. Oleh karena itu mediasi sebagai alternatif penyelesaian sengketa dapat dijadikan solusi penyelesaian untuk kepastian hukum hak atas tanah masyarakat berdasarkan inisiatif para pihak dan kantor pertanahan. Untuk melihat penyelesaian sengketa pertanahan tersebut, maka permasalahan yang diteliti pada penelitian ini adalah: 1.Apa faktor yang menyababkan terjadinya sengketa pertanahan di Kabupaten Solok Selatan?, 2. Bagaimana penyelesaian sengketa pertanahan melalui mediasi di Kantor Pertanahan Kabupaten Solok Selatan?. Penelitian ini menggunakan metode yuridis empiris. Data yang dikumpulkan berupa data primer yang diperoleh dari Kantor Pertanahan Kabupaten Solok Selatan, serta data sekunder diperoleh dari bahan hukum primer, sekunder dan tersier. Berdasarkan hasil penelitian terdapat empat faktor penyebab timbulnya sengketa pertanahan yaitu (1) adanya saling klaim kepemilikan tanah, (2) sengketa akibat perubahan status tanah milik bersama menjadi tanah milik perorangan secara melawan hukum dan tanpa kesepakatan, (3) keberatan terhadap luas dan batas tanah yang didaftarkan oleh sepadan (4) Dugaan Tumpang Tindih Sertipikat. Sesuai data Tahun 2019-2020 terdapat 22 sengketa pertanahan yang diajukan masyarakat, sengketa tersebut telah dilakukan penyelesaian melalui mediasi yaitu, 6 sengketa berhasil damai, 9 sengketa tidak berhasil damai, 4 sengketa sedang di mediasi dan 3 sengketa belum di mediasi. Akan tetapi sengketa yang berhasil damai tidak ditindaklanjuti dengan pendaftaran perjanjian pedamaiannya ke panitera Pengadilan Negeri. Termasuk waktu pelaksanaan mediasi yang melebihi 30 hari, sehingga terjadi inkonsistensi pelaksanaan mediasi dan ketidakpastian hukum penyelesaian sesuai peraturan perundang-undangan. Advisor Prof. Dr. H. Kurnia Warman, S.H., M.Hum and Dr. Azmi Fendri, S.H.,M.Kn ABSTRACT Land disputes are disputes between individuals, legal entities, or institutions that have no wide impact. However, land disputes can lead to disruption of security stability, decreased economic growth, and create social disharmony that demands settlement efforts. Settlement through the court is considered less effective for the character of the people of South Solok, because it puts the parties in the opposite position, plus to carry out community hearings must be South Solok District Government must spend a large cost and a long distance because of the absence of the District Court in the area. This includes the constraints of the reluctance of the community to resolve disputes due to the lengthy stages of the proceedings and the complexity of making the lawsuit material, which may not be accepted by the judge in his ruling. Therefore mediation as an alternative dispute resolution can be used as a solution for legal certainty of land rights of the community based on the initiative of the parties and the land office. To see the settlement of land disputes, the problems studied in this study are: 1. What are the factors that cause land disputes in South SolokRegency?. 2. How to resolve land disputes through mediation at the South Solok Regency Land Office?. This study uses empirical juridical methods. The data collected in the form of primary data obtained from the South Solok Regency Land Office,as well as secondary data obtained from primary, secondary and tertiary legal materials. Based on the results of the study there are four factors that cause land disputes, namely (1) Disputes existence of mutual land ownership claims, (2) Disputes due to changes in the status of shared property into land owned by individuals unlawfully and without agreement, (3) Objections to the area and boundaries of land registered by commensurate (4) Alleged Overlap of Sertipikat. According to the data of 2019-2020 there are 22 land disputes filed by the community, the dispute has been resolved through mediation, namely, 6 disputes were successfully peaceful, 9 disputes were not successful peacefully, 4 disputes were being mediated and 3 disputes had not been mediated. However, the dispute that succeeded peacefully was not followed up with the registration of the peace agreement to the clerk of the District Court. Including the time of mediation that exceeds 30 days, so that there are inconsistencies in the implementation of mediation in accordance and legal uncertainty sattlement with the laws and regulations.
