Abstract
KEDUDUKAN HAK TANGGUNGAN DI ATAS HAK GUNA USAHA YANG TELAH DI TETAPKAN SEBAGAI TANAH TERLANTAR DI KABUPATEN SOLOK (Alvin Rachman Putera, 1820122004, Program Magister Kenotariatan Fakultas Hukum Universitas Andalas, 115 halaman, tahun 2021 ) ABSTRAK Hak Guna Usaha adalah hak untuk mengusahakan tanah yang dikuasai langsung oleh negara untuk perusahaan pertanian, perikanan, atau peternakan dengan jangka waktu. Salah satu penyebab hapusnya HGU karena diterlantarkan. HGU termasuk salah satu hak atas tanah yang dapat dijadikan jaminan hutang dengan dibebani hak tanggungan. Hapusnya hak tanggungan karena hapusnya hak atas tanah yang dibebani hak tanggungan tidak menyebabkan hapusnya hutang yang dijamin. Pada praktiknya hapusnya HGU yang sedang dibebankan hak tanggungan karena suatu keputusan penetapan tanah terlantar menimbulkan ketidakjelasan pada pelunasan hutang antara debitur (PT. Karatau Limo Sajati) dan kreditor (PT. Bank Rakyat Indonesia Tbk.) serta sulitnya untuk melakukan pemanfaatan terhadap bekas obyek HGU yang telah ditetapkan sebagai tanah terlantar. Permasalahan dalam penelitian ini adalah 1) bagaimana proses penertiban HGU sebagai obyek tanah terlantar di Kabupaten Solok?2) bagaimana kedudukan hak tanggungan di atas HGU yang telah ditetapkan sebagai tanah terlantar di Kabupaten Solok?3) bagaimana pemanfaatan tanah bekas HGU yang di atasnya dibebani hak tanggungan setelah ditetapkan sebagai tanah terlantar di Kabupaten Solok?. Metode pendekatan yang digunakan adalah yuridis empiris, Sifat penelitian bersifat deskriptif analitis, data penelitian yang digunakan adalah berupa data primer yaitu melalui wawancara dan data sekunder yaitu melalui studi dokumen. Data tersebut diolah secara sistematis dan dianalisis. Hasilpenelitian menunjukan bahwa1) proses penertiban HGU PT. Karatau Limo Sajati sebagai obyek tanah terlantar yang dilakukan dengan cara iventarisasi, identifikasi dan penelitian, peringatan, usulan penetapan tanah terlantar dan penetapan tanah terlantar sebenarnya bisa dibatalkan melalui gugatan ke PTUN berdasarkan kelemahan yang terdapat pada proses perigatan.2) kedudukan hak tanggungan di atas HGU yang telah ditetapkan sebagai tanah terlantar tersebut telah hapus, namun hapusnya hak tanggungan karena hapusnya hak atas tanah tidak menyebabkan hapusnya hutang yang dijamin dan untuk selanjutnya pelunasan utang debitur diatur pada Pasal 1131 dan 1132 KUH Perdata.3) pemanfaatan tanah bekas HGU yang diatasnya dibebani hak tanggungan setelah ditetapkan sebagai tanah terlantar mendapatkan penundaan dari BPN RI. STANDING OF MORTGAGE RIGHTS ON CULTIVATION RIGHTS THAT HAVE BEEN DETERMINED AS DEFLANDED LAND IN SOLOK DISTRICT (Alvin Rachman Putera, 1820122004, Master of Notary Program, Law Major on Andalas University, 2021, 115 page) ABSTRACT Cultivation Rightare rights to exploit land which is directly controlled by the state for agricultural, fishery or livestock companies for a period of time. One of the reasons for the removal of the cultivation right was because it was neglected. cultivation rights is one of the land rights that can be used as collateral for debt and encumbered with mortgage rights. The write-off of the mortgage rights because the write-off of land rights that are encumbered with a security right does not cause the guaranteed debt to be written off. In practice, the abolition of the cultivation right which is being subject to mortgage rights due to a decision to determine abandoned land creates confusion regarding the repayment of debts between the debtor (PT. Karatau Limo Sajati) and the creditor (PT. Bank Rakyat Indonesia Tbk.) And the difficulty of utilizing the former cultivation right object which is has been designated as abandoned land. The problems in this research are 1) how is the process of controlling cultivation right as an object of abandoned land in Solok Regency? 2) what is the position of the mortgage rights above the cutivation rights which has been designated as abandoned land in Solok Regency? 3) how is the utilization of the ex-cultivation rights land on which a mortgage has been imposed after it has been designated as abandoned land in Solok Regency? The approach method used is juridical empirical, the nature of the research is descriptive analytical, the research data used is in the form of primary data, namely through interviews with sources and literature study to obtain secondary data. The data is processed systematically and analytically. The results showed that 1) the control process of PT. Karatau Limo Sajati as an abandoned land object which is carried out by means of inventory, identification and research, warnings, the proposal to determine abandoned land and the determination of abandoned land can actually be canceled through a lawsuit to the PTUN based on the weaknesses in the warning process. 2) the position of the mortgage over the cultivation rights which has been designated as abandoned land has been abolished, but the abolition of the mortgage because the termination of the land title does not cause the guaranteed debt to be canceled and subsequently the debtor's debt repayment is regulated in Articles 1131 and 1132 of the KUH Perdata. 3) The utilization of the ex-cultivation rights land on which a mortgage is imposed after it is designated as abandoned land is subject to a delay from BPN RI.
