Abstract
PELAKSANAAN JUAL BELI TANAH PERKEBUNAN DI KECAMATAN ENOK KABUPATEN INDRAGIRI HILIR Rionaldi, NIM: 1820123054, Program Magister Kenotariatan Fakultas Hukum Universitas Andalas, 2021, 95 Halaman ABSTRAK Dalam melakukan jual beli tanah dibutuhkan Jaminan Hukum berupa akta yang dibuat oleh Pejabat Pembuat Akta Tanah, hal ini berdasarkan Peraturan Pemerintah No. 37 Tahun 1998. Dalam praktiknya kegiatan jual beli hanya dilakukan berdasarkan perjanjian yang dibuat oleh para pihak penjual dan Pembeli tanpa melibatkan Pejabat yang berwenang dalam hal itu, hal ini tentunya bertentangan dengan kegiatan jual beli atas tanah yang diatur dalam peraturan perundang-undangan. Penelitian ini bertujuan untuk mencari pokok permasalahan yaitu ; Bagaimana Pelaksanaan jual beli tanah perkebunan di Kecamatan Enok Kabupaten Indragiri Hilir, Bagaimana proses pendaftaran tanah berdasarkan perjanjian di bawah tangan dalam jual beli tanah perkebunan pada Kecamatan Enok Kabupaten Indragiri Hilir, dan Mengapa masyarakat di Kecamatan Enok Kabupaten Indragiri Hilir cenderung melakukan perjanjian di bawah tangan dalam jual beli tanah perkebunan. Penelitian hukum ini menggunakan pendekatan yuridis Empiris. Hasil Penelitian memperlihatkan bahwa dalam jual beli tanah perkebunan di Kecamatan Enok Kabupaten Indragiri Hilir biasanya dilakukan dengan jual beli di bawah tangan, jual beli ini dianggap memiliki kekuatan mengikat jika memenuhi syarat berdasarkan ketentuan 1320 KUH Perdata, asas-asas, dan unsur dalam perjanjian. Kemudian dalam Proses pendaftaran tanah berdasarakan perjanjian di bawah tangan, pemohon mempersiapkan segala berkas yang disyaratkan oleh Peraturan KBPN Nomor 1 Tahun 2010 seperti alas hak baik itu SKGR ataupun Surat Keterangan yang berlaku di Riau, setelah berkas lengkap maka petugas ukur akan terjun ke lapangan untuk mengukur bidang tanah, setelah peta bidang tanah maka dilanjutkan pengumuman yang dilakukan oleh petugas dari BPN di kantor kelurahan/desa selama 2 (dua) bulan berturut-turut, jika dalam waktu yang ditentukan tidak terdapat sanggahan dari pihak lain maka proses selanjutnya dapat dilakukan penerbitan sertifikat. Masyarakat di Kecamatan Enok cenderung melakukan jual beli di bawah tangan dengan objek tanah perkebunan dikarenakan masih banyak masyarakat yang belum teredukasi bagaimana proses jual beli dengan objek tanah, selain itu juga mayoritas tanah perkebunan di sana belum bersertifikat.Kendala lainnya juga dikarenkan akses ke BPN dan PPAT masih jauh dari objek tanah/tempat tinggal mereka. IMPLEMENTATION OF LAND PLANTATIOPN SALE AND PURCHASE IN DISTRICT ENOK INDRAGIRI HILIR Rionaldi, Student ID: 1820123054, Master Program of Notarism Faculty of Law Andalas University, 2021, 95 Pages ABSTRACT In conducting the sale and purchase of land, legal guarantees are required in the form of deed made by the Land Deed Official, this is based on Government Regulation No. 37 of 1998. In practice, the buying and selling activities are only conducted based on the agreement made by the seller and the Buyer without involving the authorized Officials in that regard, this is certainly contrary to the buying and selling activities on land stipulated in the laws and regulations. This research aims to find the main problems, namely; How the implementation of the sale and purchase of plantation land in Enok Subdistrict Indragiri Hilir, How the process of land registration based on agreements under the hands in the sale and purchase of plantation land in The District Enok Indragiri Hilir, and Why the community in Sub-District Enok Indragiri Hilir tend to do agreements under the hands in the sale and purchase of plantation land. This legal research uses an Empirical juridical approach. The results showed that in the sale and purchase of plantation land in Enok Subdistrict Indragiri Hilir usually done by buying and selling under the hands, this trade is considered to have binding power if it meets the conditions under the provisions of 1320 Civil Code, principles, and elements in the agreement. Then in the process of land registration based on the agreement under the hands, applicant prepares all files required by KBPN Regulation No. 1 of 2010 such as the right base either SKGR or certificate applicable in Riau, after the file is complete then the measuring officer will plunge into the field to measure the land area, after the land field map then continued the announcement made by officers from BPN in the village office / village for 2 (two) months in a row, if in the specified time there is no objection from other parties then the next process can be done issuing certificates. People in Enok sub-district tend to trade under their hands with plantation land objects because there are still many people who have not been educated how the process of buying and selling with land objects, in addition to the majority of plantation land there have not been certified. Other obstacles are also due to access to BPN PPAT is still far from object/where they live. Keywords: Land Sale, Agreement, Land Registration, Plantation Land.
