Abstract

PENYELESAIAN SENGKETA GANTI KERUGIAN PENGADAAN TANAH JALAN TOL RUAS PADANG-SICINCIN (Anissa Ramadhani, 1620123029, Magister Kenotariatan Universitas Andalas, 156 Halaman, 2020) ABSTRAK Pembangunan infrastruktur yang ditujukan untuk kepentingan umum dapat menggerakkan roda perekonomian masyarakat. Pembangunan tersebut membutuhkan tanah sebagai salah satu sarana pendukungnya. Kebutuhan akan tanah untuk pembangunan dalam hal kepentingan umum dapat dipenuhi salah satunya dengan cara pengadaan tanah. Pengadaan tanah bagi pembangunan untuk kepentingan umum telah diatur melalui Undang-Undang Nomor 2 Tahun 2012. Namun dalam praktiknya selalu terdapat permasalahan dalam proses dilaksanakannya pengadaan tanah. Permasalahan pengadaan tanah umumnya tidak terlepas dari persoalan ganti kerugian. Hal ini juga menjadi persoalan dalam pembangunan Jalan Tol Trans Sumatera khususnya pada pembangunan Jalan Tol Padang-Pekanbaru Sesi I Padang-Sicincin yang mengakibatkan kegiatan pembangunannya menjadi terhambat dalam waktu yang cukup lama. Persoalan ganti kerugian ini menurut masyarakat karena harga yang ditawarkan oleh Tim Penilai Publik melalui Pelaksana Pengadaan Tanah dinilai terlalu rendah dari harga Nilai Penggantian Wajar yang diinginkan oleh masyarakat pemegang hak atas tanah. Sehingga masyarakat pemegang hak atas tanah mengajukan keberatan nilai ganti kerugian ke Pengadilan Negeri Pariaman. Rumusan masalah: 1) Bagaimana proses pelaksanaan pengadaan tanah pada pembangunan Jalan Tol ruas Padang-Sicincin? 2) Mengapa terjadi sengketa dalam pengadaan tanah Jalan Tol Ruas Padang-Sicincin? 3) Bagaimana penyelesaian sengketa dalam pengadaan tanah Jalan Tol Ruas Padang-Sicincin?. Metode penelitian hukum yang digunakan adalah yuridis sosiologis dengan mengumpulkan data primer di lapangan. Pembahasan: 1) Pelaksaanaan pengadaan tanah Jalan Tol Padang Sicincin sudah melalui tahapan yang sesuai dengan Undang-Undang Nomor 2 Tahun 2012 yakni melalui mekanisme inventarisasi dan identifikasi, penetapan nilai ganti kerugian, musyawarah penetapan bentuk ganti kerugian, serta tahap pemberian ganti kerugian. 2) Kegiatan pengadaan tanah Jalan Tol Padang-Sicincin menemui kendala serta sengketa karena nilai ganti kerugian yang ditawarkan oleh Pelaksana Pengadaan Tanah tidak disepakati oleh masyarakat. Selain itu sebagian besar tanah pada lokasi pembangunan jalan tol tersebut merupakan tanah kepemilikan masyarakat hukum adat serta tanah produktif yang digunakan sebagai lahan mata pencaharian dan sumber kehidupan masyarakat. 3) penyelesaian sengketa ganti kerugian dalam pengadaan tanah Jalan Tol Padang-Sicincin dilakukan secara litigasi atau diselesaikan di Pengadilan Negeri Pariaman. Namun hasil putusan majelis hakim menolak keberatan masyarakat pemegang hak atas tanah atas nilai ganti kerugian tersebut dan nilai ganti kerugian tetap mengacu pada nilai ganti kerugian yang sudah ditetapkan oleh Pelaksana Pengadaan Tanah. DISPUTE SETTLEMENT ON LAND PROCUREMENT PADANG-SICINCIN TOLL ROAD DEVELOPMENT (Anissa Ramadhani, 1620123029, Master Degree of Notary Andalas University, 156 Pages, 2020) ABSTRACT Infrastructure development aimed to improve all aspects of the life of the people. The development process requires land as one of its components. The need of land for infrastructure development process could be fulfilled through land procurement. Land procurement for infrastructure development purpose has been regulated through Undang-Undang No. 2 Tahun 2012. However, there are a lot of problems regarding the land procurement process. The problems regarding land procurement cannot be separated with compensation settlement process. This problem also occurred on the development process of Padang-Sicincin toll road Part I which resulted in the obstruction of the development process for a long time. The problem related to compensation settlement according to the people that settled there is that the price offered by Public Appraiser through land procurement officer is considered too low compared to fair replacement value desired by the owner of the land. Therefore, the rightful owner of the land filed a lawsuit regarding the value of compensation to Pariaman District Court. Formulation of the problem: 1) How is the process of land procurement on Padang-Sicincin Toll Road Development? 2) Why did the disputes occurred on land procurement process of Padang-Sicincin Toll Road Development? 3) How to resolve the disputes on land procurement on Padang-Sicincin Toll Road Development? The method used is sociological jurisprudence by collecting primary data on the field. Discussion: 1) The land procurement process for Padang-Sicincin Toll Road Development has been conducted according to UU No. 2 Tahun 2012 which consists of inventory and identification mechanisms, the determination of compensation value, determination of the form of the compensation, and the compensation process itself. 2) The land procurement process on Padang-Sicincin Toll Road development faces the obstacle due to the compensation value offered by land procurement officer is not accepted by the owner of the land. Besides, most of the land owner that resides in the toll road development site is customary and productive land that are utilized by the owner as the source of their income. 3) The dispute settlement process on the land procurement process of Padang-Sicincin Toll Road Development has been done by litigation process and has been resolved at Pariaman District Court. However, the judge ruled against the owner of the land regarding the compensation value and the compensation settlement will be conducted based on the value determined by land procurement officer.
