Abstract

Clove cigarettes dispute between Indonesia and the United States began with the passing of the Family Smoking Prevention regulation and Tobacco Control Act. Regulation is trying to regulate tobacco products with the specific purpose of preventing tobacco use by adolescents and reduce the impact of tobacco on public health. But in one of the article 907, this regulation beanned the circulation of several cigarettes with certain characteristics, including clove cigarettes, but exclude menthol cigarettes. Based on these exceptions apply Indonesia apply the claim beside this can be formulated several issues, such as: How does the rule of antidumping in international trade and how anti-dumping dispute settlement mechanism in the WTO framework (case study Indonesian clove cigarettes products to the United States). Where the purpose of this study was to determine and analyze clearly the problem formulation. To obtain maximum results and find the truth of an event or issue, then the problem approach used in this study is a normative legal research, which in this study was done by researching library materials and secondary data. The results of this research stated that the rule of the anti-dumping policy have not been effective can be seen from the number of anti-dumping practices were carried out despite evend the efforts has done and the Panel anticipates dumping finally decided to win one of the lawsuit Indonesia. However, the Panel does not favor both Indonesia. Panel's decision is not fair enough for Indonesia, the Indonesian government however still feel the WTO has done a good job. And until now Indonesia waiting for the United States who has been determined to implement the recommendations of the panel.
