Abstract
Indonesian state has one of the largest suppliers of labor-sending abroad, one of the countries in Asia to receive the distribution of Indonesian migrant workers are most Malaysian states. Placement of workers abroad has been started since 1970 that a national policy aimed at improving the socio-economic welfare, particularly for workers and their families. But at this point a lot of Indonesian workers who are working abroad to get the inhumane treatment by the employer or where they work, one example of a case that recently occurred on one of the workers who work in Malaysia who was shot by Malaysian police for allegedly committing a crime as a masked villain and carrying machetes, while there is no evidence that the alleged. Problems in this paper are: a) How is the implementation of the responsibilities given by the State of RI to protect Indonesian workers working in Malaysia? b) What are the policies related to the protection of migrant workers provided by the Malaysian state? Therefore, the thesis entitled: "Implementation Mechanism State Responsibility in Protecting Indonesian Migrant Workers in Overseas" is an essay that describes and discusses the full, how legal arrangements in international and national law. In international law, the placement and protection of migrant workers to Malaysia stated in two memorandum of understanding (MoU), MoU for the workers who work in the formal sector, signed in 2004, and MoU in 2006 for workers who domestic worker and ILO (International Labour Organitation) governing the International Labour. Indonesia joined in this organization began on 12 July 1950 by the State of Indonesia in the statement Letter Of Application (LoA) by the Prime Minister of the Republic of Indonesia (RIS) Dr. Mohammad Hatta. Indonesia there are regulations governing the placement and protection of Indonesian migrant workers found in Law No. 39 of 2004 and other regulations such as the Law No. 13 Year 2003 about Basic Provisions of Employment, and the Ministry of Manpower and Transmigration No.Kep/104A/MEN/2002 about placement of Indonesian workers abroad as well as the regulation observance.
