Abstract

PELAKSANAAN PENGAWASAN OLEH BADAN PERTANAHAN NASIONAL (BPN) TERHADAP PEJABAT PEMBUAT AKTA TANAH (PPAT) YANG MELAKUKAN PELANGGARAN DI KOTA PADANG (Dedek Astani, 1820123024, Program Studi Magister Kenotariatan Fakultas Hukum Universitas Andalas, 94 halaman, 2020) ABSTRAK Dalam kehidupan bernegara, setiap orang memiliki hak yang sama di hadapan hukum. Meskipun demikian, bukan berarti setiap orang bebas untuk berbuat apa saja, segala sesuatunya memiliki aturan hukum yang apabila dilanggar akan dikenakan sanksi sesuai dengan aturan yang mengatur. Dengan kata lain hukum harus ditegakkan agar tercipta kehidupan yang harmonis. Penegakkan hukum tersebut juga tidak terkecuali bagi PPAT, PPAT juga dapat dikenakan sanksi apabila melanggar aturan hukum.Oleh karena itu, dalam melaksanakan tugas jabatannya PPAT harus mendapatkan pengawasan supaya tidak melakukan pelanggaran terhadap jabatannya. Dengan adanya Peraturan Menteri Nomor 2 Tahun 2018 tentang Pembinaan dan Pengawasan terhadap Pejabat Pembuat Akta Tanah, PPAT harus berpedoman pada aturan tersebut, agar dapat menjalankan tugas jabatannya dengan baik. Namun ketika PPAT melanggar aturan, tidak tertutup kemungkinan adanya penjatuhan sanksi kepada PPAT tersebut, seperti pemberhentian dengan hormat, pemberhentian dengan tidak hormat, pemberhentian sementara, atau bahkan dengan teguran tertulis.Metode yang digunakan dalam penelitian ini adalah Metode Empiris yang dianalisis secara kualitatif.Untuk memperkuat hasil penelitian maka dilakukan wawancara dengan pihak terkait di tempat lokasi penelitian.Berdasarkan hasil penelitian diperoleh kesimpulan bahwa Kepala Kantor Wilayah BPN/ Kepala Kantor Pertanahan memiliki wewenang dalam melakukan pembinaan dan pengawasan terhadap PPAT, dimana Kepala Kantor Wilayah BPN/ Kepala Kantor Pertanahan membentuk Majelis Pengawas dan Pembina PPAT untuk membantu menyampaikan dan menjelaskan kebijkan yang telah ditetapkan oleh Menteri perihal pelaksanaan tugas jabatan sebagai PPAT.Kemudian meskipun sudah diberlakukannya Permen Nomor 2 Tahun 2018, namun penegakkan hukum tersebut tidak sesuai dengan yang diharapkan.PPAT yang sedang menghadapi permasalahan hukum seakan-akan berjuang sendiri tanpa adanya pengawasan dari Majelis Pembina dan Pengawas PPAT.Bahkan PPAT yang memang sudah dinyatakan bersalah tidak mendapatkan sanksi dari BPN atau Majelis Pembina dan Pengawas PPAT. Dengan kata lain, pengawasan terhadap PPAT tersebut tidak ada dilakukan sama sekali. Selanjutnya, terdapat kendala dalam melaksanakan pembinaan dan pengawasan terhadap PPAT oleh BPN dan Majelis Pembina dan Pengawas PPAT seperti : Belum adanya petunjuk teknis (juknis) / petunjuk pelaksanaan (juklak) bahkan belum adanya Standar Operasi Prosedur (SOP) yang jelas dan tegas mengenai pengawasan terhadap PPAT. kemudian tidak seimbangnya antara jumlah Majelis Pembina dan Pengawas PPAT dengan jumlah PPAT itu sendiri menyebabkan terkendalanya proses pengawasan oleh BPN dan Majelis Pembina dan PengawasPPAT. Kata kunci : Pengawasan , BPN, dan Pelanggaran PPAT IMPLEMENTATION OF SUPERVISION BY THE NATIONAL LAND AGENCY (BPN) TOWARDS THE LAND-MAKER OFFICERS (PPAT) THAT ARE INFRINGINGIN PADANG CITY (Dedek Astani, 1820123024, Notary Master's Study Program, Law Faculty, Andalas University, 94 pages, 2020) ABSTRACT In a state life, everyone has the same rights before the law. Even so, it does not mean that everyone is free to do anything, everything has a rule of law which is ifviolated, it will be given such a sanction in accordance with the rules that govern. In other words the law must be upheld in order to create a harmonious life. Law enforcement is also no exception for PPAT, PPAT may also be subject to sanctions if it violates the rule of law. Therefore, in carrying out his duties PPAT must get supervision so as not to violate his position. With the Ministerial Regulation No. 2 of 2018 concerning Development and Supervision of Land Deed Making Officials, PPAT must be guided by these rules, so that they can carry out their duties properly. However, when PPAT violates the rules, it is possible to impose sanctions on the PPAT, such as dismissal with respect, dismissal with disrespect, temporary dismissal, or even with a written warning. The method used in this study is the Empirical Method which is analyzed qualitatively. To strengthen the research results, interviews were conducted with relevant parties at the research location. Based on the results of the study concluded that the Head of the BPN Regional Office / Head of the Land Office has the authority to conduct guidance and supervision of PPAT, where the Head of the Regional Office of BPN / Head of the Land Office establishes the Supervisory Board and Trustees of PPAT to help convey and explain the policies set by the Minister regarding the implementation of job duties as PPAT. Then despite the enactment of Permen Number 2 of 2018, but the law enforcement is not as expected. PPAT who is facing legal issues seems to be fighting alone without supervision from the PPAT Board of Trustees and Supervisors. Even PPAT who had been found guilty did not get sanctions from BPN or the PPAT Board of Trustees and Supervisors. In other words, there is no oversight of the PPAT at all. Furthermore, there are obstacles in carrying out the guidance and supervision of PPAT by the BPN and the PPAT Board of Trustees and Supervisors such as: There are no technical guidelines (technical guidelines) / implementation instructions (operational guidelines) even there is no clear and firm Standard Operating Procedure (SOP) regarding supervision of PPAT. then the imbalance between the number of PPAT Board of Trustees and Supervisors with the number of PPAT itself causes the process of supervision by the BPN and the Board of Trustees and Supervisors of PPAT.
