Abstract

Online loans are part of the rapidly growing technology-based financial services industry in Indonesia. However, amid this growth, unlicensed online loan applications have proliferated, raising legal concerns about the validity of agreements made through unlicensed platforms. The research problem is: 1. What is the legal status of multilateral financing agreements made through unlicensed online loan applications, as reviewed by the Civil Code and POJK No. 40 of 2024? 2. What are the legal enforcement efforts against unlicensed online loan practices to ensure legal certainty and protection for the parties involved in multilateral financing agreements? The research method used is juridical normative with a statutory approach. The results of the study show that, although the elements of agreement and competence of the parties may be met, the use of unlicensed online loan providers causes the agreement to be contrary to the order of the financial services sector and does not meet the objective requirement of a legitimate cause. Therefore, financing agreements made through unlicensed online loan applications not only violate administrative regulations but also have legal implications, rendering them void. Furthermore, OJK Regulation No. 40 of 2024 focuses on regulating licensed providers and therefore does not explicitly address the civil consequences of contracts arising from illegal providers. Therefore, integrated law enforcement through administrative, civil, and criminal instruments is needed to emphasize that unlicensed online lending practices are not only administrative violations but also violate the principles of legality and legal certainty in the Indonesian contract system.
