Abstract

deed of peace are binding and have the same legal force as court decisions that have permanent legal force, and cannot be appealed or cassated. In resolving civil disputes through a small claim court process that is fairly lighter in accordance with its principles, namely simple, fast, low cost to open broad access to justice. The problems discussed in this thesis are (1) How is the implementation of a deed of peace (acte van dading) as a settlement of civil disputes through a small claim court process in the padang district court, (2) What legal consequences arise if one of the parties defaults on the contents of the deed of peace (acte van dading) in the padang district court. The research method used is empirical juridical, the type of data used is primary data and secondary data, to obtain primary data and secondary data used primary legal materials and secondary legal materials, as well as data collection techniques, namely literature studies and interviews, data analysis techniques using qualitative analysis. The results of the research obtained are (1) Settlement of civil disputes through a small claim court process, namely with a quick settlement and a small claim court that can be considered lighter in accordance with its principles, namely simple, fast and light costs and (2) If one of the parties defaults on the contents deed of peace (acte van dading) in a civil dispute, the court will not be able to resolve the dispute.
