Abstract

This work is aimsed to knowing how the approach of the government of Indonesia in protecting the Indonesian Workers (TKI) that penalized the death penalty in foreign court and to know what obstacles the government of Indonesia found in protecting the Indonesian Workers who received the death penalty inforeign court. To answer the problems formulation, the author use normative legal research method that aims at the written regulations only or other legal materials,where mostly the research to do on secondary data that is available in the libraries.Based on the result of this study that the government of Indonesia protected the Indonesian Workers who received the death penalty in foreign court, it through the representative, both diplomatic and consular representation. Specifically for Indonesian Workers who are prosecuted under the law, the government of Indonesia provided legal aids priority that begins fix)m checking assistance, case monitoring, advocacy, counseling psychology, contacting families and family's assistance in collaboration with Indonesian employment agencies within the framework of accreditation and the advocate designation. Conclusion the government of Indonesia also has the obstacles in protecting Indonesian Workers who received the death penalty in foreign court. One of these obstacles is law differences with the recipient country that makes the government of Indonesia has to make the great efforts to protect the Indonesian Workers.
