Abstract

To gain victory in a war or armed conflict, some Countries utilize the service of mercenaries in completingcritical missions in order to achieve the ambitious visions. They are the ones who dare to act in face of great risk of possible life threatening. But the soldiers are not tool or weapon, they are also human beings who in their self in herent fundamental rights as a human. Mercenary or mercenaries who are alaso called the soldier of fortune was the army that fought and attaced in an armed conflict for the sake of money or payment, and usually with little appreciation of ideology, nationality, or political ideology as reperensented are listen, in additional protocol I of 1949 Geneva conventions article 47. In International humanitarian law no law that gives a clear provision and protection must be linked to mercenaries, both the 1949 genva conventions and additional protocol I of 1977. But just give meaning and definition of who can be regarded as mercenaries, the international humanitarian law is the rule of the law as a guide line for the international community, considering that at the present intensity and forms of armed conflict increasingly modem and cunning, by looking at the presence of mercenaries in several armed conflict. This explaints that the mercenaries have a fairly large share in an amed conflict. There for, the provisions concerning the presence of mercenaries should be describled in more detail so that compliance with the international community in the creation of an intemational armed conflict. Of scientific papers prepared by the method is grided by normative Juridical Geneva conventions of 1949, an additional protokol in 1977, and intemational conventions on human rights, as well as other supporting data in the form of journals and papaers are expected to assist us in over coming the problem.
