Abstract

ABSTRAK Developer bisa melakukan pemasaran atau penjualan terhadap rumah yang dibangunnya dengan salah satu persyaratannya yaitu developer sudah melakukan pembangunan perumahan paling sedikit 20% (dua puluh persen). Namun hal ini masih ada dilanggar oleh pihak developer, dimana developer sudah melakukan pemasaran atau penjualan rumah dengan menggunakan rumah contoh. Permasalahan yang dapat dikemukakan dalam tesis ini adalah Bagaimana Perlindungan Hukum Terhadap Konsumen Dalam Perjanjian Pendahuluan Jual Beli Rumah Di Wilayah Kecamatan Siak Hulu Kabupaten Kampar, Apa akibat hukum terhadap developer yang melakukan Perjanjian Pendahuluan Jual Beli Rumah Di Wilayah Kecamatan Siak Hulu Kabupaten Kampar dan Bagaimana bentuk pengawasan terhadap developer yang melakukan Perjanjian Pendahuluan Jual Beli Rumah Di Wilayah Kecamatan Siak Hulu Kabupaten Kampar. Metode penelitian yang digunakan dalam penelitian ini menggunakan metode yuridis empiris, sifatnya, penelitian ini merupakan penelitian deskriptif analisis. Metode pengumpulan dilakukan dengan field research (wawancara) dan library research (penelitian kepustakaan). Berdasarkan hasil penelitian penulis, Pelaksanaan perjanjian pendahuluan jual beli rumah di wilayah Kecamatan Siak Hulu Kabupaten Kampar adalah belum berjalan dengan baik dikarenakan masih ada developer yang tidak menjalankan perjanjian pendahuluan jual beli rumah yang sudah menjadi kesepakatan diantara developer dengan konsumen terutama tidak sesuainya jangka waktu penyelesaian rumah dan fasilitas yang sudah ditawarkan oleh piak developer, Perlindungan hukum terhadap konsumen dalam perjanjian pendahuluan jual beli rumah atas developer yang tidak memenuhi persyaratan Undang-Undang Di Wilayah Kecamatan Siak Hulu Kabupaten Kampar adalah belum berjalan dengan baik dikarenakan developer melakukan kelalaian terhadap perjanjian pendahuluan jual beli rumah yang disepakati dengan kosnumen padahal developer sudah menerima pembayaran dari konsumen sehingga perjanjian pendahuluan jual beli tersebut menimbulkan kerugian bagi konsumen, dan Bentuk pengawasan terhadap developer dalam melakukan Perjanjian Pendahuluan Jual Beli Rumah Di Wilayah Kecamatan Siak Hulu Kabupaten Kampar adalah masih sebatas syarat administrasi yang sifatnya preventif terhadap tindakan melawan hukum dari developer dikarenakan permasalahan yang terjadi ketika sudah terlaksananya penyelenggaraan perumahan dan kawasan permukiman oleh developer tidak lagi menjadi tanggung jawab pemerintah apabila terjadi wanprestasi atau penipuan terhadap konsumen. The problems that can be raised in this thesis are How Legal Protection for Consumers is in the Preliminary Agreement for the Sale and Purchase of Houses in the Siak Hulu District, Kampar Regency, What are the legal consequences for developers who enter into the Preliminary Agreement for the sale and purchase of houses in the Siak Hulu District, Kampar Regency, and what are the forms of supervision? against developers who enter into Preliminary Agreements for Sale and Purchase of Houses in the Siak Hulu District, Kampar Regency. The research method used in this study uses empirical juridical methods, its nature, this research is a descriptive analysis research. The collection method was carried out by field research (interviews) and library research (library research). Based on the results of the author's research, The implementation of the preliminary sale and purchase agreement for houses in the Siak Hulu District, Kampar Regency has not gone well because there are still developers who do not carry out the preliminary agreement for buying and selling houses which has become an agreement between the developer and the consumer, especially the timeframe for completing the house and the facilities provided. already offered by the developer, Legal protection for consumers in the preliminary agreement for buying and selling houses for developers who do not meet the requirements of the Law in the Siak Hulu District, Kampar Regency, has not gone well because the developer has neglected the preliminary agreement for buying and selling houses that was agreed with consumers even though the developer has already receive payments from consumers so that the preliminary sale and purchase agreement causes harm to consumers dan the form of supervision of developers in carrying out Preliminary Agreements for Sale and Purchase of Houses in the Siak Hulu District, Kampar Regency is still limited to administrative requirements that are preventive in nature against unlawful actions from developers due to problems that occur when the implementation of housing and residential areas by developers is no longer is the government's responsibility in the event of default or fraud against consumers Keywords: Legal Protection, Consumers and Preliminary Agreements
