Abstract

PERTIMBANGAN PENUNTUT UMUM MEMILIH TEMPAT TERJADINYA TINDAK PIDANA DALAM MENDAKWA PELAKU YANG MELAKUKAN TINDAK PIDANA DI LUAR DAERAH HUKUMNYA PADA SURAT DAKWAAN REGISTER PERKARA: PDM-15/PPJNG/Eoh.2/03/2021 (Yunita Eka Putri, NIM.2120113060, 119 Halaman, Program Studi Magister Ilmu Hukum Universitas Andalas, 2023) ABSTRAK Penuntut Umum adalah Jaksa pada Kejaksaan Republik Indonesia yang diberi wewenang oleh undang-undang untuk melakukan penuntutan, yang pada prosesnya termasuk pula wewenang untuk membuat surat dakwaan. Dalam melaksanakan wewenang tersebut, Pasal 15 dan Pasal 137 Kitab Undang-Undang Hukum Acara Pidana (KUHAP) memberikan batasan bagi Penuntut Umum sesuai dengan wilayah hukumnya, kendati demikian, dalam praktiknya masih ditemukan Penuntut Umum yang mendakwa pelaku tindak pidana yang berada di luar daerah hukumnya. Tujuan dalam penelitian ini untuk mengetahui pertimbangan Penuntut Umum pada Kejaksaan Negeri Padang Panjang dalam mendakwa pelaku yang melakukan tindak pidana diluar daerah hukumnya sebagaimana pada surat dakwaan nomor register perkara: PDM-15/PPJNG/Eoh.2/03/2021 atas nama terdakwa Aziarlis Bin Ameh Pgl Ziar dan juga untuk mengetahui akibat hukum surat dakwaan Penuntut Umum yang mendakwa pelaku tindak pidana diluar daerah hukumnya. Dengan menggunakan metode penelitian hukum empiris dengan menggunakan data primair yang diperoleh dengan cara mewawancarai Hakim, Advokat dan Penuntut Umum dan juga menggunakan data sekunder berupa dokumen terkat perkara dimaksud. Dari hasil Penelitian diperoleh:1) Pertimbangan bagi Penuntut Umum untuk melakukan penuntutan terhadap tindak pidana diluar daerah hukumnya dilatar belakangi oleh alasan yuridis dan alasan non yuridis. Adapun alasan yuridis merujuk pada ketentuan Pasal 2 ayat (2) Undang-undang Nomor 11 Tahun 2021 tentang Perubahan Atas Undang-undang Nomor 16 Tahun 2004 tentang Kejaksaan Republik Indonesia. Alasan non yuridis sejarah terbentuknya kejaksaan Negeri Padang Panjang. 2) Akibat hukum terhadap surat dakwaan yang dibuat oleh Penuntut Umum yang tidak berwenang belum diatur di dalam KUHAP, sehingga dalam prakteknya terdapat dualisme bagi hakim dalam memandang persoalan penuntutan yang dilakukan oleh Penuntut Umum di luar daerah hukumnya sehingga menimbulkan ketidak pastian hukum dalam pelaksanaan penegakan hukum itu sendiri. THE CONSIDERATION OF PUBLIC PROSECUTOR IN DETERMINING THE LOCATION OF CRIME SCENE IN CHARGING CRIMINAL PERPETRATOR WHO COMMITTED EXTRA-JURISDICTIONAL CRIMINAL OFFENSE THROUGH THE INDICTMENT NO: PDM-15/PPJNG/Eoh.2/03/2021 (Yunita Eka Putri, SID.2120113060, 119 Pages, Master of Law Studies Program, University of Andalas, 2023) ABSTRACT Public Prosecutor is a prosecutor at the Attorney General's Office of the Republic of Indonesia who is authorized by law to conduct prosecutions, which process includes the authority to compose indictments. In exercising this authority, Article 15 and Article 137 of the Criminal Procedural Code (KUHAP) provide limitations for Public Prosecutors to conduct prosecutions within their jurisdictions, however, in practice it is found that Public Prosecutors indict criminal offenders who committed crimes outside their given jurisdiction (extra-jurisdictional). To study this phenomenon and its legal consequences, this research examines the consideration of the Public Prosecutor at Padang Panjang District Prosecutor's Office who indicted the perpetrator of criminal offense outside its given jurisdiction, as found in indictment No. PDM-15/PPJNG/Eoh.2/03/2021 on behalf of the defendant Aziarlis Bin Ameh Pgl Ziar and also to find out the legal consequences of the Public Prosecutor's indictment which charges perpetrators of criminal acts outside their jurisdiction. By using empirical legal research methods using primary data obtained by interviewing Judges, Advocates and Public Prosecutors and also using secondary data in the form of documents related to the case in question. From the research results it was obtained: 1) Considerations for Public Prosecutors to prosecute criminal acts outside their jurisdiction are motivated by juridical reasons and non-juridical reasons. The juridical reasons refer to the provisions of Article 2 paragraph (2) of Law Number 11 of 2021 concerning Amendments to Law Number 16 of 2004 concerning the Prosecutor's Office of the Republic of Indonesia. Historical non-juridical reasons for the formation of the Padang Panjang District Prosecutor's Office. 2) The legal consequences of indictments made by Public Prosecutors who are not authorized have not been regulated in the Criminal Procedure Code, so that in practice there is a dualism for judges in viewing the issue of prosecutions carried out by Public Prosecutors outside their jurisdiction, giving rise to legal uncertainty in the implementation of law enforcement itself.
