Abstract

ANALYSIS OF THE NEED OF HEALTH LAW ASSISTANCE IN PADANG CITY 2018. By: Alfi Rudiman (1620322002) Under the guidance of dr. Hardisman, MHID, Dr. PH and H. Ikhsan Yusda, PP. SH, LLM. ABSTRACT Complaints over health issues in Padang City over the past few years indicate there is an increased in whether complaints are to the Legal Aid Institute or other Institutions related to complaints. This shows the growing awareness of law in the community will be need health care good and acceptable by all levels of society. This study aims to analyze the factors of need of Legal Aid Institute health based system framework included : Input, Proces, Output and Outcome of 11 institutions consisting of : Ombudsman, Padang City health office, 4 Legal Aid Institutions that have provided free legal aid services, 5 health profession organizations (IDI, PDGI, IBI, PPNI, IAKMI). This type of research is qualitative by using system method. Primary data were obtained by conducting field observations and indepth interview. Secondary data is collected by reviewing both documents literature, laws, regulations relating to the problem under study. The results of this study indicate that the policy implementation of the handling of complaints of health problems by the Legal Aid Institute until now there is no specific rules regulating the provision of legal aid on health. The process of handling health complaints by LBH has not been maximally handled because the standard activity reference or (SOP) for the handling of health complaints does not exist. Outcome of this study majority of informants said the need for LBH Health by involving health workers in the implementation. Because of the existence of LBH health will used for health professional organizations, communities, insurance etc. Obstacles to the implementation of LBH health: lack of human resources health interest to participate in the process of handling of health law and still lack of public awareness related to health law. ABSTRAK Pengaduan persoalan kesehatan di Kota Padang dalam beberapa tahun terakhir menunjukkan adanya peningkatan baik itu pengaduan yang ke Lembaga Bantuan Hukum atau Lembaga-lembaga lain yang berkaitan dengan persoalan pengaduan. Hal tersebut menunjukkan semakin tumbuhnya kesadaran hukum di masyarakat akan penting pelayanan kesehatan yang baik dan dapat diterima oleh semua lapisan masyarakat. Penelitian ini bertujuan menganalisis faktor-faktor kebutuhan Lembaga Bantuan Hukum kesehatan berdasarkan kerangka sistem meliputi : Input, Proses, Output dan Outcome terhadap 11 lembaga/institusi yang terdiri dari : Ombudsman dan Dinas Kesehatan Kota Padang, 4 Lembaga Bantuan Hukum yang telah memberikan pelayanan bantuan hukum gratis, 5 organisasi profesi kesehatan (IDI, PDGI, IBI, PPNI, IAKMI),. Jenis penelitian ini adalah kualitatif dengan menggunakan metode pendekatan sistem. Data primer didapatkan dengan melakukan pengamatan di lapangan dan wawancara mendalam. Data sekunder dikumpulkan dengan menelaah dokumen baik itu literatur, Undang-Undang, Peraturan yang berkaitan dengan masalah yang diteliti. Hasil penelitian ini menunjukkan bahwa kebijakan pelaksanaan penanganan pengaduan persoalan kesehatan oleh Lembaga Bantuan Hukum sampai saat ini belum ada aturan yang khusus mengatur tentang pemberian bantuan hukum tentang kesehatan. Proses penanganan pengaduan kesehatan oleh LBH belum maksimal ditangani karena acuan kegiatan atau SOP yang baku untuk penanganan pengaduan kesehatan tidak ada. Outcome dari penelitian ini mayoritas informan mengatakan perlu adanya LBH Kesehatan dengan melibatkan tenaga kesehatan dalam pelaksanaanya. Karena keberadaan LBH kesehatan akan bermafaat bagi organisasi profesi kesehatan, masyarakat, asuransi dll. Hambatan pelaksanaan LBH kesehatan : kurangnya minat SDM kesehatan untuk turut serta dalam proses penanganan hukum kesehatan dan masih minimnya kesadaran masyarakat yang berkaitan dengan hukum kesehatan.
