Abstract

SUPERVISION OF AUTHORARY CODE BY VIOLATION OF THE CODE OF ETHICS BY THE REGIONAL AREA OF INDONESIAN NOTARIS IN PADANG CITY (Nisaul Hasanah,1620123080, Post Graduate of Notary Program Faculty of Law Andalas University,Thesis , 2018) ABSTRACT Notary is a profession that demands the holder of a position and the profession has scientific competence and moral competence. Based on the code of ethics, the result of the amendment is interesting to see the supervision and enforcement of code of ethics to the notary who violate the code of ethics by the board of the Indonesian Notary Association (INI). The problems to be discussed are 1). How is the supervision and enforcement of the code of ethics against the notary who violates the code of ethics by the board of the Indonesian Notary Association (INI)? 2). What is the coordination relationship between the board of the Indonesian Notary Association (INI) and the Notary Supervisory Board over the violation of the notary code of ethics? 3). What are the legal issues that arise in relation to the supervision of a notary who violates the code of ethics by the board of the Indonesian Notary Association (INI) ?. This research uses descriptive method of sociological juridical approach. Research data includes secondary data. Data collection technique is by interview and then data is analyzed by using qualitative method. Based on the research, the authors conclude that the supervision and enforcement of the code of ethics against the notary that violates the code of ethics by the Regional Administrator of Padang Ikatan Notaris Indonesia (INI). Supervision and enforcement of notary code of ethics by Padang Regional Administrator Association of Indonesia Notary Association (INI) implemented by Regional Honor Board. Supervision and enforcement of ethical codes shall be implemented on a multi-level level where if the suspected violation of the code of ethics is not satisfied with the decision of the regional honorary council, or region may then be able to appeal the Central Board of Honor, and if not satisfied with the decision of the Central Board of Honor then may be appealed to Congress. The coordination relationship between the Padang Regional Administrator of the Indonesian Notary Association (INI) and the Notary Supervisory Board through periodic coordination, and the recommendation which is the authority of the Central Board of Honor. While the Legal Issues that arise related to the Supervision of Notary who conduct Violation of Code of Conduct by the Regional Board of Padang City of Notary Association of Indonesia (INI) that is not yet adequate rules related to notary examination by Notary Board of Notary Indonesian Notary Bond.
