Abstract

Penguasaan tanah oleh Negara dimaknakan sebagai kewenangan negara untuk mengatur peruntukkan dan penggunaan dari tanah tersebut, sehingga dapat memberikan manfaat yang sebesar-besarnya bagi kesejahteraan masyarakat banyak.Salah satu faktor terjadinya tanah negara yaitu tanah negara terjadi karena bekas hak barat yang mana dalam rentan waktu 20 tahun jika tidak dilakukan pengalihan penguasaan atas tanah hak barat maka secara langsung tanah tersebut dikuasai oleh negara.Permasalahan dalam penelitian ini adalah (1)Bagaimana Terjadinya Tanah Negara di Kota Padang (2) Bagaimana Proses Pembuktian Hak Atas Tanah yang berasal dari Tanah Negara bekas erfpacht verponding 1794 di Kota Padang (3) Bagaimana proses pendaftaran tanah hak milik atas tanah negara bekas erfpacht verponding 1794 di Kota Padang.Metoda Penelitian yang dilakukan adalah yuridis empiris dan penelitian ini bersifat penelitian deskriptif analis,serta pengumpulan data yang digunakan adalah data primer dan data sekunder.berdasarkan hasil penelitian, diketahui bahwa(1)terjadinya tanah negara dapat berupa melalui proses tanah ulayat nagari yang didaftarkan oleh ketua adat nagari,dapat terjadi karena bekas hak barat,terjadi karena pemegang hak atas tanah warga negara asing dan dapat terjadi karena tanah timbul reklamasi(2)proses pembuktian hak atas tanah negara bekas erfpacht verponding 1794 yaitu menyerahkan surat pernyataan penguasaan fisik ke kantor pertanahan,dikeluarkan surat perintah setor,dilakukan pengukuran,pengecekan oleh Panitia A,diterbitkan surat keputusan,diterbitkan sertipikat,(3)proses pendaftaran tanah hak milik atas tanah negara berkas erpacht verponding 1794 di kota Padang yaitu mengajukan surat permohonan ke kantor pertanahan,penerimaan biaya pengukuran,dilakukan pengukuran,penerbitan surat keputusan dari kepala kantor pertanahan,pembayaran BPHTB,mendaftarkan kembali hak nya ke kantor pertanahan,pembukuan hak dan penerbitan sertipikat,penyerahan sertipikat kepada pemegang hak atas tanah. Kata Kunci : Pemberian Hak Milik, Tanah Negara, Hak Erfpacht Verponding. PROVIDING THE PROPERTY RIGHTS ON SOUTH EAST STATE ERFPACHT VERPONDING 1794 IN PADANG CITY (Name: Dihka Almira Faith, S.H, BP Number: 1520122018, Master Program of Notary, Faculty of Law, University of Andalas, Number of Pages: 101) ABSTRACT Land tenure by the State is defined as the authority of the state to regulate the designation and use of the land, so as to provide the greatest benefit for the welfare of the community. One of the occurrence of state land that is state land occurs because of the former rights of the west which in 20 years time if no transfer of control over land rights of the west then the land is directly controlled by the state. The problems in this study are (1) How Occurrence of State Land in Padang City (2) How is the Land Proof Procurement Process that comes from the former State Land erfpacht verponding 1794 in Padang City (3) How is the land ownership process of the former country erfpacht verponding 1794 in Padang City. The research method is empirical juridical and this research is descriptive research analyst, and data collection used is primary data and secondary data. Based on research result, it is known that (1) the occurrence of state land can be through the process of ulayat nagari land registered by the chairman adat nagari, can occur because of the former rights of the west, occurs because the holder of the rights of land of foreign citizens and can occur due to land reclamation arises (2) the process of verification of land rights of the former country erfpacht verponding 1794 ie submit a statement of physical control to the land office, (3) land ownership registration process on state land file erpacht verponding 1794 in the city of Padang is submitting application letter to the land office, acceptance of measurement fee, done measurement, issuance of a decree from the head of the land office, payment of BPHTB, re-register his rights to the land office, the bookkeeping of rights and issuance of the certificate, the transfer of the certificate to the holder of the land rights.
