Abstract

Child is a part of nation router. Child who have conflict with jurisdictional constitute is a form of juvenile delinquency, it is because of epoch development can influence behaviour of the child. Therefore parent role and society counsellor really gets essential role in formation child behaviour. In another case, jurisdictional justice is a constitute method to manage human life is utilized as medium to reach justice.So we can said that law as life regulator of society. Child who have conflict with the law is preconceived child does a crime. But, the rights of the kids should be ptotected by getting justice with restorative approaching (restorative justice), which is by diversion as a mechanism should be used in childcrime jurisdiction system and use it in every step of enquiry. The diversion arranged in Indonesia Regulation No. 11/2012. Therefore in this research writer does research by used approaching sociologis, and primary data collecting tecknique also by adding secondary data. In this reseach we will talking about : 1. How is diversion implementing to child who have conflict with the jurisdictional, at TheDistrict Court Klas IA of Padang City according to Indonesia Regulation No. 11/2012 ? 2. What is the preventof diversion implementing at District Court Klas IA of Padang City ? 3. How is theworking out methodefor the implementation of diversion at The District Court Klas IA of Padang City ?. The result of this research is Implementation of Diversion at The District Court Klas IA of Padang City still not according to Indonesia Regulation of Child Crime Justice System. Then, the implementation still have some prevent that influence by culture and implementation of law. And effort that is done to constraint working out of diversion implemantation according to Indonesia Regulation of Child Crime Justice System so that the diversion will be exist in court level, so the rights of that child as a criminal can be protected for their future to be better.
