Abstract
"THE FOREIGN POLICY OF THE REPUBLIC OF INDONESIA INRESPONDING TO THE SOUTH CHINA SEA CONFLICT ACCORDING TO UNCLOS 1982" (Mustika Sukma Utari, 2020112012, Master of Law Study Program, Faculty of Law, Andalas University, 2023) ABSTRACT Indonesia is an archipelagic country with a geopolitical understanding of wawasan nusantara perspective and mandates of the 1945 Constitution. This is the base of Indonesia's political policy in responding to the South China Sea conflict involving China and countries in Southeast Asia. Even though Indonesia declares itself as a non-climant state but it always giving full support to reach the solution. Unfortunately, a concrete legal solution for the parties has not been reached till know, even though the Philippines has taken China to the Permanent Court of Arbitration. An important point in the problem of this research is how Indonesia's diplomacy as a solution to the conflict in the South China Sea based on UNCLOS 1982, as well as the solution carried out by Indonesia in responding to China's unilateral claim to ownership of the North Natuna sea area based on UNCLOS 1982 and Indonesia's national interests?. After conducting research and interviews with competent parties at the Ministry of Foreign Affairs of the Republic of Indonesia, researchers concluded that the efforts of Indonesia and ASEAN countries to create a Code of Conduct (CoC) with China is one of the best conflict management that can be done nowadays. Although the CoC is confidential and cannot be accessed in general, the existence of the CoC, so far the escalation in the region has been able to be suppressed and the actions of the parties measurable. There are many positive things obtained by Indonesia by being actively involved in the CoC discussion process. In addition, the existence of the Natuna sea area which is included in China's Nine Dash Line claim is holds a lot of oil and gas, fisheries, and tourism potential. It is part of Indonesia’s sovereignty territory that must be maintained, from outside intervention.
