Abstract

Dalam banyak perkara korupsi yang ditangani oleh penegak hukum, sering melahirkan tindak pidana pencucian uang (TPPU). Tindak pidana pencucian uang tidak selalu dilakukan oleh pelaku predicate crime seperti tindak pidana korupsi (tindak pidana korupsi) atau tindak pidana lainnya yang dapat menjadi tindak pidana asal terhadap TPPU, tetapi juga oleh orang-orang yang secara pasif menerima dan/ atau menikmati hasil pencucian uang tersebut. Banyak pelaku TPPU baik laki-laki maupun perempuan yang mengalirkan kekayaan hasil TPPU kepada suami atau isterinya yang dikenal sebagai TPPU pasif. Eksistensi TPPU pasif tertuang dalam rumusan Pasal 5 Undang-Undang Nomor 8 Tahun 2010 tentang Pencegahan dan Pemberantasan Tindak Pidana Pencucian Uang (UU TPPU). Dalam praktik, penerapan Pasal 5 UU TPPU sudah pernah dilakukan yang terbukti dengan dua kasus yang cukup mencuri perhatian yaitu kasus EA (isteri FS, terdakwa kasus tindak pidana penipuan dan atau penggelapan dalam jabatan dan atau pencucian uang) dan AG (suami siri MD, terdakwa kasus pembobolan dana nasabah Citibank sebesar Rp 40 miliar). Permasalahan dalam tesis ini adalah 1) Kewenangan penyidikan KPK terhadap TPPU dan 2) Kewenangan penyidikan KPK terhadap TPPU dan hambatan yang dihadapi KPK. Penulisan tesis ini menggunakan metode penelitian yuridis empiris yang berlokasi di KPK. Data primer didapat dengan melakukan wawancara terhadap Jaksa Penuntut Umum KPK dan data sekunder diperoleh dari penelitian bahan-bahan kepustkaan yang terdiri dari undang-undang dan bahan hukum lain yang berkaitan. Data-data tersebut dianalisa dengan menggunakan teknik analisis deskriptif dan analisis isi. Dari hasil penelitian dengan metode di atas, penulis memperoleh jawaban atas permasalahan yang ada bahwa pada dasarnya secara jelas KPK telah diberi amanat oleh UU TPPU menjadi salah satu penyidik terhadap TPPU yang tertuang dalam Pasal 74 UU TPPU, namun hingga saat ini KPK belum pernah menjerat pelaku TPPU dengan Pasal 5 UU TPPU yang disebabkan oleh keterikatan kewenangan KPK menangani tindak pidana korupsi dengan syarat sebagaimana tertuang dalam Pasal 11 Undang-Undang Nomor 30 Tahun 2002 tentang Komisi Pemberantasan Korupsi (UU KPK) sehingga yang selama ini telah disidik KPK adalah pelaku TPPU yang dikenal dengan TPPU aktif. THE AUTHORITY OF THE CORRUPTION ERADICATION COMMISSION (CEC/ KPK) IN CONDUCTING INVESTIGATION AGAINST PASSIVE MONEY LAUNDERING CRIMINAL ACT ABSTRACT Corruption cases which are handled by the law enforcement task forces often leads to money laundering (TPPU). Money laundering is not always committed by the subjects of predicate crime such as corruption or other crimes which are the most potential common criminal cases which lead to TPPU, but also by those who passively accept and/ or enjoy the benefits of the money laundering. The majority of TPPU’s subjects transferred or shifted the fund from money laundering crime to their husband or wife who is known as passive subjects. The existence of passive subjects contained in the formulation of Article 5 of Law No. 8 of 2010 on the Prevention and Combating of Money Laundering (AML Law). In the practice, the application of Article 5 AML Law has been conducted the two cases are quite attracted the public attention i.e. the case of EA (wife of FS, convicted of criminal fraud or embezzlement in her function and or money laundering) and AG (unregistered husband of MD, alleged of Citibank case of embezzlement of Rp 40 billion). The discussions in this thesis are: 1) Corruption Eradication Commission investigative authority against money laundering and 2) Corruption Eradication Commission investigative authority against passive TPPU and the obstacles faced by KPK. This thesis using legal empirical located in KPK. The primary data obtained through interviews with the Prosecution of KPK and secondary data obtained from library research materials consisting of laws and other legal related materials. The data was analyzed using descriptive analysis techniques and content analysis. The research shows that KPK absolutely has given a mandate by the AML Law into one of investigator depend on Article 74 of the AML Law but until now KPK has not been ensnare offenders AML with Article 5 of Law AML caused by entanglement authority of KPK dealing corruption with the requirements as stated in Article 11 of Act number 30 of 2002 on KPK Act so that had been investigated by the Commission was TPPU known actors with active TPPU.
