Abstract

Penetapan Taman Nasional Tesso Nilo sebagai kawasan konservasi bertujuan untuk menjaga kelestarian alam, agar ekosistem yang ada dalam kawasan hutan itu tidak terganggu. Disisi lain, akibat dari penetapan kawasan hutan juga mengakibatkan atau timbulnya konflik, yaitu salah satunya terdapat kepemilikan sertipikat hak milik yang sah didalam kawasan Taman nasional. Maka berdasarkan hal tersebut dilakukan penelitian tentang perlindungan hukum terhadap pemegang sertipikat hak milik atas tanah dalam kawasan taman nasional tesso nilo di Kabupaten Indragiri Hulu. Adapun permasalahan yang dibahas adalah Bagaimanakah proses penetapan kawasan Taman Nasional Tesso Nilo dan kepemilikan sertipikat hak atas tanah di Kabupaten Indragiri Hulu?; Bagaimanakah kedudukan sertipikat hak milik di dalam dalam kawasan Taman Nasional Tesso Nilo di Kabupaten Indragiri Hulu?; Bagaimanakah proses pemberian ganti rugi dalam pembebasan hak milik atas tanah dalam kawasan Taman Nasional Tesso Nilo di Kabupaten Indragiri Hulu?. Tipe penelitian yang digunakan adalah yuridis empiris, dengan data yang bersumber pada penelitian data sekunder yang kemudian dilanjutkan dengan penelitian data primer dilapangan (wawancara). Dari hasil penelitian yang dilakukan maka dapat disimpulkan bahwa kegiatan penetapan kawasan hutan konservasi Taman Nasional Tesso Nilo di Kabupaten Indragiri Hulu diawali dengan adanya SK Kemenhut No. 255/Menhut-II/2004 kemudian ditindak lanjuti dengan kegitan penunjukkan, penataan batas, pemetaan dan terakhir dikeluarkan SK tentang penetapan kawasan. Kedudukan sertipikat hak milik dalam kawasan Taman Nasional Tesso Nilo tetap sah, sepanjang belum adanya belum adanya pembebasan pemberian ganti rugi oleh negara.pembebasan dan pemberian ganti rugi terhadap kepemilikan sertipikat dalam kawasan belum terlaksana sebagimana mestinya, yakni mengacu pada pengadaan tanah, karena masalah tumpang tindih antara kepemilikan sertipikat dan penetapan kawasan belum menemui titik penyelesaian, yang sampai saat ini masalah tersebut telah sampai kepada Komnas HAM sebagai pihak penengah atau sebagai mediator untuk menyelesaikan masalah ini. Dasar hukum pengadaan tanah yang digunakan yakni Keppres Nomor 55 Tahun 1993, karena penetapan kawasan Taman Nasional Tesso Nilo baru dilakukan pada tahun 2004 sesuai dengan SK penetapan Menhut Nomor 255/Menhut-II/2004. Apabila pengadaan tanah itu tetap terlaksana, maka tidak ada ganti rugi, karena Taman Nasional tidak termasuk dalam objek pengadaan tanah untuk kepentingan umum berdasarkan pasal 5 Keppres Nomor 55 tahun 1993. Kata kunci: perlindungan hukum, hak atas tanah, dan Taman Nasional. LEGAL PROTECTION AGAINST CERTIFICATE HOLDERS OF LAND IN THE TESSO NILO NATIONAL PARK IN DISTRICT INDRAGIRI HULU, RIAU PROVINCE ABSTRACT Determination as Tesso Nilo National Park of conservation area to preserve the nature so these existing ecosystems in forest are protected. On the other hand, as a result of the establishment of the forest area resulted conflicts, Containing a certificate of ownership property lawfully within the national park. Based on that reasons So there is a research on the legal protection of the holder of certificates for the land in the Tesso Nilo national park in the District Indragiri Hulu. The issues discussed is how the process of determining Tesso Nilo National Park area and the ownership certificates of land rights in Indragiri Hulu? How is the position of property certificate in tesso nilo park in indragiri hulu? How the compensation in the acquisition of land in the Tesso Nilo National Park in Indragiri Hulu? The type of research is juridical empirical, with data that originates in the secondary data research , followed by a primary data field research (interviews) . From the result of the research, it concluded that the activities of the establishment of conservation forest areas of Tesso Nilo National Park in Indragiri Hulu begins with Kemenhut Decree No. 255 / Menhut - II / 2004 and then followed up with the activities of the designation, boundary marking , mapping and last a decree on the establishment of the region . Position certificates of property rights within Tesso Nilo National Park is still valid as long as there are no acquisition by the state. The acquisition and compensation has not been done properly, which refers to the land acquisition , because the problem of overlapping between property certificate and estabilishment of the area has not met the completion point, that is until now the problem has come to the Komnas HAM as an intermediary or as a mediator to resolve this problem. The legal basis used for land acquisition Keppres No.55 of 1993, for the determination of Tesso Nilo National Park area was conducted in 2004 accordance with determination of SK Menhut No. 255/Menhut-II/2004. When land acquisition was still made, then no compensation, because the Tesso Nilo National Park is not included in the object of the procurement of land for public purpose in article 5 of the presidential number 55 of 1993.
