Abstract

The United States of America begin to use drone as a weapon in 200 I in Afghanistan and then in 2004 in Pakistan to hunt down members of al - Qaeda and the Taliban as pafi of the Global War on Terrorism. Controversy arose when the US action resulted in civilian casualties and destruction of civilian objects , both in Afghanistan and Pakistan , it was thought that the US had violated international humanitarian law. To figure that out, the author formulate two issues, first, how the rules of drones as a weapon in armed conflict under international humanitarian law, second, how is the practice of using drones by the United States in Pakistan and Afghanistan can be categorized as a violation of international humanitarian law. Research method used in this thesis is a normative research method. This study uses primary legal materials, secondary and tertiary. The data sources of this research is literature, the internet and study the document. and then analyzed. From these results known that first. there is no specifrc regulation on drones make countries have their own interpretation in this regard, particularly the use of drones as a weapon carried by the USSecond, there must be specific rules regarding the use of drones to be made in detail and clearly, so that there is little possibility of a gap that could be violated. The I-lS responsible for some cases of drone attacks that eause death to civilians, the destruction of civilian property, which should not be a military target in armed conflict, as well as the indiscriminate attack actions which is prohibited by international humanitarian law and the US actions was causing the prejudical impact to the civilians in Afghanistan and Pakistan.
