Abstract

In the practise of this time, we can find so many fact that a notary is brought to the court, as a defendant, suspect, malefactor, or witness in kind of civil despute and criminal case. Notary is not as a subject that insentive of the law, but a notary have the right to get the law protection and treated fairly. In this thesis, the author discusses how the form of law protection for the notary toward to the act that made in course of jurisdiction, according to the regulation and how the cause of act that made by notary when is disputed in the court. For this thesis, the author use normatif research method. Based on the research, when the notary is fronted in civil despute as a witness, co-defendant or defendant, the notary is not have a require permit from Honorary Committee of Notary. On the other hand, when the notary is fronted in criminal case as a witness, suspect or befendant, the notary need a require permit from Honorary Committee of Notary. Honorary Committee of Notary should be listened the clarification of notary and also check the mistake or collision which have been done by notary and it must be integral holistic, based on the act that made. The legal consequence of the act that made by notary when there is a dispute in a court, the notary deed is irrevocable or inalienable with anything, include of civil justice or crime justice. Because, the notary deed is a represent of parties. The notary deed can be cancelled or repealed by the parties or the people that appear in front of the notary. The notary deed can be degradationed from the authentic act become underhand act based on the desicion of civil jurisdiction.
