Abstract

Perlindungan Hukum Terhadap Pemegang Hak Atas Tanah Yang Sudah Terdaftar Yang Berada Pada Lahan Gambut Di Kota Pekanbaru Irma Wati, Program Megister Kenotariatan Fakultas Hukum Universitas Andalas, 92 halaman, Tesis, 2021 ABSTRAK Penyertifikatan lahan milik masyarakat terus berjalan, karena lahan milik warga baik yang berupa perkarangan maupun ladang, akhirnya memiliki status yang jelas. Dengan berserifikat lahan tersebut memiliki kekuatan hukum, juga memiliki kekuatan atau nilai ekonomi. Banyak sekali dijumpai kasus tanah yang sebagian besar mulanya adalah daratan tetapi kini justru sebagian besar masuk ke dalam peta lahan gambut dan dalam proses penyertifikasian masyarakat menjumpai kendala, salah satu kendalanya adalah adanya kebijakan baru dari Pemerintah Pusat tentang moratorium lahan gambut. Dikarenakan tidak ada sosialisasi yang memadai, maka kebijakan ini mengejutkan dan membingungkan warga, dan celakanya pembuatan peta atau kawasan yang masuk kelahan gambut tidak dilakukan secara cermat. Kemudian bagaimana proses pendaftaran tanah di kawasan gambut berdasarkan Intruksi Presiden Republik Indonesia Nomor 5 Tahun 2019 di Kota Pekanbaru? Bagaimana peran pemerintah daerah terkait dalam pendaftaran tanah masyarakat di lahan gambut tersebut? Bagaimana perlindungan hukum terhadap pemegang hak atas tanah yang sudah terdaftar yang berada di kawasan gambut di Kota Pekanbaru? Memberikan informasi kepada pembaca bagaimana proses pendaftaran tanah di kawasan gambut berdasarkan Intruksi Presiden Republik Indonesia Nomor 5 Tahun 2019 di Kota Pekanbaru. Mengetahui peranan pemerintah terkait proses sertifikasi kawasan gambut tersebut. Untuk mengetahui bagaimana perlindungan hukum terhadap pemegang hak atas tanah yang sudah terdaftar (pemegang sertipikat) yang berada di kawasan gambut di Kota Pekanbaru. Metode pendekatan yang dilakukan adalah metode pendekatan Yuridis Empiris, Pendekatan Yuridis Empiris adalah suatu pendekatan yang dilakukan untuk menganalisis sejauh mana suatu peraturan perundangan hukum berlaku efektif sehingga lingkup penelitian adalah inventarisasi hukum positif yang merupakan kegiatan pendahuluan, di sini peneliti tidak hanya mengungkapkan segi negatif dari suatu permasalahan namun juga segi positif sehingga dapat diberikan suatu solusi. Proses Pendaftaran Tanah Kawasan Gambut Berdasarkan Intruksi Presiden Republik Indonesia Nomor 5 Tahun 2019 di Kota Pekanbaru Pemohon mengajukan peta analisis ke kantor pertanahan. Hasil dari Badan Pertanahan Kota Pekanbaru berupa peta dan surat analisis tetang lahan gambut. Pemohon membuat permohonan klarifikasi ke dirjen planologi dilampiran hasil dari BPN yang berupa peta dan surat analisis tersebut. With a certificate the land has legal force, it also has economic power or value. There are so many land cases, most of which were originally land, but now most of them are included in the peat land map and in the process of community certification they encounter obstacles, one of the obstacles is the new policy from the Central Government regarding the moratorium on peatlands. Due to the lack of adequate socialization, this policy surprised and confused the residents, and unfortunately the making of maps or areas that fall into peatlands was not carried out carefully. Then how is the process of registering land in peat areas based on the Presidential Instruction of the Republic of Indonesia Number 5 of 2019 in Pekanbaru City? What is the role of the relevant local government in the registration of community land on the peatlands? How is the legal protection for holders of registered land rights located in peat areas in Pekanbaru City? Provide information to readers on the process of registering land in peat areas based on the Presidential Instruction of the Republic of Indonesia Number 5 of 2019 in Pekanbaru City. Knowing the government's role in the peat area certification process. To find out how the legal protection for registered land rights holders (certificate holders) located in peat areas in Pekanbaru City. The approach method used is the Juridical Empirical approach, the Juridical Empirical Approach is an approach taken to analyze the extent to which a legal regulation is effective so that the scope of research is a positive legal inventory which is a preliminary activity, here the researcher does not only reveal the negative aspects of a problems but also positive aspects so that a solution can be given. Process of Land Registration for Peat Area Based on Instruction of the President of the Republic of Indonesia Number 5 of 2019 in Pekanbaru City The applicant submits an analytical map to the land office. The results from the Land Agency of Pekanbaru City are in the form of maps and letters of analysis regarding peatlands. The applicant makes a request for clarification to the director general of planology attached to the results of the BPN in the form of a map and a letter of analysis.
