Abstract

ABSTRAK AKIBAT HUKUM PEMBLOKIRAN SERTIPIKAT TANAH DI KOTA PADANG Oleh : R E T N O S A R I NIM 2020123007 Pendafataran tanah bertujuan untuk memberikan kepastian hukum dan perlindungan kepada pemegang hak atas suatu bidang tanah, satuan rumah susun dan hak-hak lain yang terdaftar agar dengan mudah dapat membuktikan dirinya sebagai pemegang hak yang bersangkutan. Pemblokiran sertipikat merupakan bentuk tindakan administrasi Kepala Kantor Pertanahan atau pejabat yang ditunjuk untuk menetapkan keadaan status quo (pembekuan) pada hak atas tanah yang bersifat sementara terhadap perbuatan hukum dan peristiwa hukum atas tanah tersebut. Penulis melakukan penelitian dengan menggunakan metode penelitian Yuridis Empiris. Hasil penelitian ditemukan bahwa proses pemblokiran sertipikat tanah di Kota Padang dapat dilakukan dengan mudah akan tetapi setelah terjadi pemblokiran pada sertipikat tersebut pemohon mengalami berbagai macam kesulitan pada saat melakukan pencabutan pemblokiran dikarenakan penerapan Permen ATR/BPN Nomor 13 Tahun 2017 tentang Tata Cara Blokir dan Sita tidak berjalan sebagaimana mestinya. Kesimpulan dari penulis bahwa prosedur pelaksanaan pemblokiran dan tahapannya harus mengacu pada Permen ATR/ BPN Nomor 13 Tahun 2017 tentang Tata Cara Blokir dan Sita. Saran dari Penulis adalah Pihak Kantor Pertanahan sudah seharusnya melakukan implementasi berdasarkan peraturan-peraturan yang berlaku agar bertujuan memudahkan masyarakat dalam melakukan segala hal yang berkaitan dengan pengurusan sertifikat untuk hak atas tanah karena pada era masa sekarang prosedur administrasi haruslah efisien dan praktis yang akan berdampak baik pada aspek kehidupan masyarakat. Kata Kunci: Blokir, Sertipikat, BPN, Permen ATR/BPN 13 Tahun 2017 ABSTRACT LEGAL CONSEQUENCE OF THE LAND CERTIFICATES BLOCKING IN PADANG CITY by : R E T N O S A R I NIM 2020123007 Land registration aims to provide legal certainty and protection to the holder of the title to of land, apartment unit and other registered rights so that he can easily prove himself as the holder of the right in question. Blocking a certificate is a form of administrative action by the Head of the Land Office or an appointed official to determine the status quo (freezing) of temporary land rights against legal actions and legal events on the land. The author conducted research using the Juridical Empirical research method. The results of the study found that the process of blocking land certificates in Padang City could be done easily, but after blocking the certificate, the applicant experienced various difficulties when revoking the blocking due to the application of Permen ATR/BPN Number 13 of 2017 concerning Procedures for Blocking and Confiscation. running as it should. The conclusion from the author is that the blocking implementation procedure and its stages must refer to the ATR/BPN Ministerial Regulation Number 13 of 2017 concerning Procedures for Blocking and Confiscation. Suggestion from the author is that the Land Office should carry out implementation based on applicable regulations in order to make it easier for the community to do everything related to the management of certificates for land rights because in the present era administrative procedures must be efficient and practical which will have a good impact on aspects of community life.
