Abstract

AKIBAT HUKUM PENITIPAN SERTIPIKAT HAK ATAS TANAH KEPADA NOTARIS/PPAT TERKAIT PROSES BALIK NAMA SERTIPIKAT DI KOTA PADANG (Triesha Morina Ramadi, 1920123028, Program Studi Magister Kenotariatan, Fakultas Hukum Universitas Andalas, 2022) ABSTRAK Penitipan Sertipikat yang terjadi selama ini umumnya terjadi atas dasar kepercayaan dan kesepakatan dari para pihak kepada Notaris/PPAT. Notaris/PPAT menerima penitipan tersebut sepenuhnya hanya dalam kedudukannya sebagai penerima titipan. Sehingga, akibat dari keduanya adalah yaitu adanya perjanjian penitipan antara Notaris/PPAT dengan pemilik Sertipikat. Terkait Penitipan Sertipikat, berdasarkan Undang-Undang Nomor 2 Tahun 2014 tentang Perubahan Atas Undang-Undang Nomor 30 Tahun 2004 tentang Jabatan Notaris dan Peraturan Pemerintahan nomor 24 Tahun 2016 tentang Perubahan atas Peraturan Pemerintah Nomor 37 Tahun 1998 Tentang Peraturan Jabatan Pejabat Pembuat Akta Tanah, Kode Etik Notaris dan Kode Etik PPAT mengenai kewajiban atau kewenangan Notaris/PPAT tidak ada disebutkan bahwa Notaris/PPAT berkewajiban menerima titipan Sertipikat hak atas tanah dari para pihak. Hal ini berarti berlaku ketentuan mengenai penitipan dalam KUHPerdata sebagaimana termuat dalam Pasal 1706 penerima titipan wajib memelihara barang titipan itu dengan sebaik-baiknya seperti memelihara barang-barang kepunyaan sendiri. Sehingga penelitian ini mengangkat masalah: 1) Mengapa Terjadinya Penitipan Sertipikat kepada Notaris/PPAT dalam Proses Balik Nama Sertipikat di Kota Padang? 2) Bagaimana Proses Terjadinya Penitipan Sertipikat Kepada Notaris/PPAT dalam Proses Balik Nama Sertipikat di Kota Padang? 3) Bagaimana akibat hukum Penitipan Sertipikat kepada Notaris/PPAT dalam Proses Balik Nama Sertipikat di Kota Padang? Pendekatan yang digunakan adalah pendekatan hukum Yuridis Empiris. Penelitian ini menggunakan data primer. Data dianalisis secara kualitatif. Hasil penelitian yang diperoleh adalah: (1) Terjadinya penitipan Sertipikat pada Notaris/PPAT dikarenakan pembeli tidak memenuhi kewajibannya sesuai nilai yang disepakati pada jual beli (2)Proses terjadi penitipan sertipikat ialah untuk proses balik nama ke BPN (Badan Pertanahan Nasional (3)Salah satu Akibat Hukum dari penitipan Sertipikat tanah kepada Notaris/PPAT berdasarkan ketentuan pasal 1694, 1706, dan 1708 KUH perdata adalah bahwa Notaris hanya boleh melakukan suatu perbuatan hukum atas Sertipikat yang dititipkan sesuai dengan kehendak para pihak. Kata Kunci: Akibat Hukum, Balik Nama, Sertipikat Hak Atas Tanah DUE TO THE LEGAL DEPOSIT OF CERTIFICATE OF LAND RIGHTS TO A NOTARY/PPAT RELATED TO THE CHANGING PROCESS OF LAND RIGHTS IN THE CITY OF PADANG (Triesha Morina Ramadi, 1920123028, Notary Masters Study Program, Faculty of Law, Andalas University, 2022) ABSTRACT The deposition of certificates that have occurred so far generally occurs on the basis of trust and agreement from the parties to the Notary/PPAT. The Notary/PPAT accepts the safekeeping fully only in his position as the recipient of the deposit. So, the result of both is that there is a safekeeping agreement between the Notary/PPAT and the certificate owner. Regarding the Custody of Certificates, based on Law Number 2 of 2014 concerning Amendments to Law Number 30 of 2004 concerning the Position of Notary Public and Government Regulation Number 24 of 2016 concerning Amendments to Government Regulation Number 37 of 1998 concerning the Regulation of the Position of Land Deed Officials, Code Notary Ethics and the PPAT Code of Ethics regarding the obligations or authorities of a Notary/PPAT do not state that a Notary/PPAT is obliged to receive a deposit of a certificate of land rights from the parties. This means that the provisions concerning safekeeping in the Civil Code as contained in Article 1706, the recipient of the deposit is obliged to maintain the deposited goods as well as possible, such as maintaining their own property. So that this research raises the following issues: 1) Why does a certificate deposit occur with a notary/PPAT in the process of transferring the name of a certificate in the city of Padang? 2) What is the Process for Entrusting Certificates to Notaries/PPAT in the Process of Transferring Certificates in Padang City? 3) What are the legal consequences for the custody of a certificate to a notary/PPAT in the process of transferring the name of a certificate in the city of Padang? The approach used is the Juridical Empirical approach. This study uses primary data. Data were analyzed qualitatively. The results of the research obtained are: (1) The occurrence of safekeeping of the Certificate at a Notary/PPAT because the buyer does not fulfill his obligations according to the agreed value in the sale and purchase (2) The process of depositing the certificate is for the process of changing the name to the BPN (National Land Agency (3) False One of the legal consequences of depositing land certificates to a Notary/PPAT based on the provisions of Articles 1694, 1706, and 1708 of the Civil Code is that a Notary may only carry out a legal action on a Certificate deposited in accordance with the wishes of the parties.
