Abstract

“PELAKSANAAN ITSBAT NIKAH DARI PERKAWINAN POLIGAMI DI PENGADILAN AGAMA PAYAKUMBUH KELAS 1B (StudiKasusPutusanNomor 0121/Pdt.G/2018/PA.Pyk) (Arianto Ramadan, BP 20112036,Program StudiIlmuHukum Program Pascasarjana, FakultasHukumUniversitasAndalas, 96hlm, 2022) ABSTRAK PerkawinanialahikatanlahirbatinantaraseorangpriadanseorangwanitasebagaisuamiistridengantujuanmembentukkeluargayangbahagiadankekalberdasarkanKetuhanan Yang MahaEsa.Pasal 2 ayat (1) Undang-UndangNomor 1 Tahun 1974 tentangPerkawinan menyatakan bahwa perkawinanadalahsah, apabiladilakukanmenuruthukum Agama dankepercayaanmasing-masing. Undang-Undang Perkawinan menyatakan bahwa tiap-tiap perkawinan dicatat menurut peraturan perundang-undangan yang berlaku, Kompilasi Hukum Islam membuka kesempatan kepada mereka untuk mengajukan permohonan itsbatnikah (penetapan nikah) kepada Pengadilan Agama. Itsbat nikah dapat dikelompokkan dalam perkara yang tidak mengandung unsur sengketa (yurisdiksi voluntair). PedomanTeknisAdministrasidanTeknisPeradilan Agama 2008, bahwaPekawinan yang tidakdicatatkanoleh PPN banyakberindikasikanpenyelundupanhukumuntukmempermudahpoligamitanpaprosedurhukum, danmemperolehhak- hakwarisatauhak - hak lain ataskebendaanUntukkepentingantersebut, maka proses pengajuan, pemeriksaandanpenyelesaianpermohonanitsbatnikahharusmengikutipetunjukBuku II. Berdasarkan hal tersebut, penulis tertarik untuk melakukan penelitian tentang BagaimanaPelaksanaanItsbatNikahdariPerkawinanPoligami di Pengadilan Agama PayakumbuhKelas 1B?, ApaDasar Pertimbangan Hakim Dalam Memutus Perkara Itsbat Nikah Nomor: 0121/Pdt.G/2018/PA.Pyk di Pengadilan AgamaPayakumbuhKelas 1B?,ApaAkibatHukumPenetapanItsbatNikahdariPerkawinanPoligamiberdasarkanPutusanNomor: 0121/Pdt.G/2018/PA.Pyk di Pengadilan AgamaPayakumbuhKelas 1B? Penulisantesisinimenggunakanmetodepenelitianhukumnormatifyangmenggunakanstudikepustakaan.Dari hasilpenelitiandiketahuibahwaPelaksanaanItsbatnikahdariperkawinanpoligamiberdasarkanPutusanNomor 0121/Pdt.G/2018/PA.Pyk di Pengadilan AgamaPayakumbuhKelas 1B meskipun hakim mengabulkanpenetapantersebutatasdasaruntukmengeluarkanaktakelahirananak, Dasarpertimbangan hakim dalammenetapakanPerkarainiuntukKepastianhukumdankemanfaatan, namunsecarahukumacaraadalangkah-langkah yang tidakdijalani. Pasal 3 ayat 2 Undang-UndangPerkawinanterkaitIzinPoligamiolehPengadilan, seharusnyadilakukanpermohonanizinpoligamibarusetelahitubaru di ajukanpenetapananak.AtaupermohonanIzinpoligami di komulasikandenganpermohonanPengesahannikah.jika hakim berusahauntukmengejarkepastianhukum agar anaktersebutmendapatkanaktakelahiran. Sepertinya hakim kurangmencermatiPermendagriNomor 9 tahun 2016 yang telahmenjaminanakluarkawinbisamendapatkanakatkelahiranya. AkibatHukumdariPutusanNomor 0121/Pdt.G/2018/PA.PykanakbisamendapatkanaktakelahirandariDukcapildenganmencantumkannamakeduaorangtuanyadanterkaitKepentinganKewarisanantaraPemohon II besertaanak-anaknyadanTermohon I dariIstripertamaPemohon I memilikihak yang samasesuaidenganketentuanUndang-undang yang berlakudansesuaidenganketentuanHukum Agama. Kata Kunci: PerkawinanPoligami, Itsbat Nikah, Pengadilan Agama IMPLEMENTATION OF MARRIAGE ITSBAT FROM POLYGAMY MARRIAGE IN PAYAKUMBUH RELIGIOUS COURT, CLASS 1B (Decision Case Study Number 0121/Pdt.G/2018/PA.Pyk) (Arianto Ramadan, BP 20112036, Graduate Program in Law, Faculty of Law, Andalas University, 96 pp., 2022) ABSTRACT Marriage describes the inner birth between a man and a woman as husband and wife with the aim of forming a happy family based on the One Godhead. Article 2 paragraph (1) of Law Number 1 of 1974 concerning Marriage states that marriage is legal, if it is carried out according to the law of each religion and belief. The Marriage Law states that every marriage is recorded according to the applicable laws and regulations, the Islamic Law Compilation opens the opportunity for them to submit an application for itsbatnikah (marriage determination) to the Religious Courts. Itsbat marriage can be studied in cases that do not contain elements of dispute (volunteer jurisdiction). Technical Guidelines for the Administration and Technical of the Religious Courts 2008, that marriages that are not registered by the PPN have many indications of legal smuggling to facilitate polygamy without legal procedures, and obtain inheritance rights or other rights to material. the completion of the marriage itsbat must follow the instructions of Book II. Based on this, the authors are interested in conducting research on How is the Implementation of Marriage Itsbat from Polygamous Marriages in the Payakumbuh Religious Court Class 1B? Marriage from a Polygamous Marriage based on Decision Number: 0121/Pdt.G/2018/PA.Pyk in the Payakumbuh Religious Court Class 1B? The writing of this thesis uses a normative legal research method that uses a literature study. From the results of the study it is known that the implementation of itsbat marriage from polygamous marriages is based on Decision Number 0121/Pdt.G/2018/PA.Pyk in the Payakumbuh Religious Court Class 1B even though the judge granted the determination on the basis of issuing a child's birth certificate, the judge's consideration in determining the case This is for legal certainty and benefit, but legally there are steps that are not taken. Article 3 paragraph 2 of the Marriage Law related to Polygamy Permits by the Court, an application for a new polygamy permit should be made after that only a child determination is submitted. Or the application for a polygamy permit is combined with an application for marriage validation. if the judge tries to pursue legal certainty so that the child gets a birth certificate. It seems that the judge did not pay close attention to Permendagri Number 9 of 2016 which has guaranteed that children out of wedlock can get birth certificates. Legal Consequences of Decision Number 0121/Pdt.G/2018/PA.Pyk children can get a birth certificate from the Dukcapil by including the names of both parents and related to the Inheritance Interests between Petitioner II and their children and Respondent I from the first wife of Petitioner I has the same rights the same in accordance with the provisions of the applicable law and in accordance with the provisions of Religious Law.
